The subject of the study is an opinion on the constitutionality of the parliamentary draft act – Provisions Introducing the Act on the Constitutional Tribunal, filed on 6 March 2024. The author discusses the circumstances of the draft and its relation to other acts aimed at restoring the proper systemic role of the Constitutional Tribunal. In conclusion, it is stated that, taking into account all the elements of the legislative package aimed at repairing the Constitutional Tribunal, the author of this opinion does not see anything in the draft act – Provisions Introducing the Act on the Constitutional Tribunal, filed on 6 March 2024, that could indicate the clear unconstitutionality of the proposed solutions. Regardless, some provisions, especially the provision of Article 7 of the draft, should be subject to further work in the course of the legislative process due to the difficulties and practical doubts that may arise.
