Chronione Nazwy Pochodzenia i Chronione Oznaczenia Geograficzne stanowią na poziomie Unii Europejskiej główne formy ochrony wysokiej jakości produktów rolnych związanych z określonym pochodzeniem geograficznym. Pomimo tego, iż należą one do dwóch różnych zbiorów przepisów, Unia Europejska zmierza do ustanowienia możliwie najbardziej ujednoliconych ram prawnych, które udzielałyby jednolitej odpowiedzi w związku z tymi kategoriami jakości. Najnowsze rozporządzenie Parlamentu Europejskiego i Rady (UE) nr 2117/2021 z 2 grudnia 2021 r. zmienia rozporządzenia (UE) 1151/2012 i 1308/2013 między innymi po to, aby zbliżyć definicje nazwy pochodzenia i oznaczenia geograficznego zawarte w tych aktach. Oba teksty chronią wymienione kategorie jakości, obok innych zakazanych działań, przed jakimkolwiek niewłaściwym stosowaniem, imitacją czy przywołaniem, jakim mogłyby podlegać. W szczególności pojęcie przywołania ewoluowało na poziomie wykładni Trybunału Sprawiedliwości Unii Europejskiej w przedziale między najstarszym wyrokiem z marca 1999 r. a tym najnowszym z września 2021 r. Celem niniejszej pracy jest ukazanie ewolucji tego pojęcia dla lepszego rozumienia jego zakresu oraz wagi.

Protected Designations of Origin and Protected Geographical Indications are, at the European Union level, the main forms of protection afforded to high-quality agricultural products linked to a specific geographical origin. Despite the fact that they belong to two different sets of rules, the European Union seeks to establish a most harmonised legal framework that would provide a uniform response in relation to these quality categories. The latest Regulation (EU) No 2117/2021 of the European Parliament and of the Council of 2 December 2021 amends Regulations (EU) 1151/2012 and 1308/2013 in order, inter alia, to approximate the definitions of the “designation of origin” and “geographical indication” contained in these acts. Both texts protect the aforementioned quality categories, alongside other prohibited activities, from any misuse, imitation or invocation to which they could be subject. The concept of reference arose in particular at the interpretative level of the Court of Justice of the European Union between the oldest judgment of March 1999 and this most recent one of September 2021. The aim of this paper is to show the evolution of this concept for a better understanding of its scope and importance.

Las Denominaciones de Origen Protegidas y las Indicaciones Geográficas Protegidas constituyen las principales figuras de protección a nivel de la Unión Europea de los productos agroalimentarios de calidad vinculados a un origen geográfico determinado. Pese a estar integrados en dos cuerpos normativos diferentes, la Unión Europea pretende crear un marco regulador lo más unificado posible que dé una respuesta uniforme a estas figuras de calidad, aproximando ambos reglamentos. Con este propósito, el reciente Reglamento (UE) núm. 2117/2021, de 2 de diciembre de 2021 del Parlamento Europeo y del Consejo, modifica los Reglamentos 1151/2012 y 1308/2013 para, entre otras cuestiones, aproximar las definiciones de “denominación de origen” y de “indicación geográfica” contenidas en ambos bloques normativos. Ambas normativas protegen estas figuras, frente, entre otras acciones prohibidas, a cualquier uso indebido, imitación o evocación que de las mismas se pudiera realizar. Concretamente, el concepto de evocación ha sufrido una evolución interpretativa por parte del Tribunal de Justicia de la Unión Europea desde la sentencia más antigua, que data de marzo de 1999, hasta la más reciente, de septiembre de 2021. El objetivo de este trabajo es poner de manifiesto la evolución de este concepto para entender mejor su alcance e importancia.
