Kompetencje kreacyjne biskupa diecezjalnego w wykonywaniu władzy sądowniczej

W wykonywaniu władzy sądowniczej przez biskupa diecezjalnego można wyróżnić cztery rodzaje przysługujących mu kompetencji: władcze, kreacyjne, koordynacyjne i nadzorcze. Realizacja kompetencji kreacyjnych przez biskupa w sprawowaniu władzy sądowniczej stanowi cel artykułu. Na początku analizie poddano regulacje prawne dotyczące erygowania trybunału w diecezji oraz ustanawiania urzędów obligatoryjnych i fakultatywnych. Urzędami obligatoryjnymi są: wikariusz sądowy, sędziowie, promotor sprawiedliwości, obrońca węzła oraz notariusz. Urzędami fakultatywnymi są: pomocniczy wikariusz sądowy, kierownik kancelarii sądu, stali obrońcy. Następnie został scharakteryzowany trybunał międzydiecezjalny. Taki sąd pierwszej instancji może utworzyć zgodnie kilku biskupów diecezjalnych dla swoich Kościołów partykularnych.

In the exercise of judicial power by the diocesan bishop it’s possible to distinguish four kinds of competences: governance, creative, coordination and supervisory. Realization of creative competences by the bishop is the purpose of the article. At the beginning were analyzed legal regulations concerning the erection of the tribunal in the diocese and establishment mandatory and optional offices. Mandatory institutions are: court vicar, judges, justice promoter, defender of the bond and notary. Optional offices are: auxiliary court vicar, court chancellor, standing lawyer. The inter-diocese tribunal was then characterized. Such a court of first instance may form in accordance with several diocesan bishops for their particular Churches.
