The article describes the progress of judicial reform in Ukraine from the time it gained independence to present days. The article analyzes the main stages of judicial reform, including their timeframes, related legislative regulations and content of reforms. It has been proved that the judicial reform in Ukraine is far from its completion, and the requirement of consistency of its implementation can be accomplished through recognition of judicial law as a branch of law which regulates social relations related to administration of justice.

Scientific research paper entitled “Judicial control of administrative activity and advantages of reorganization of the judicial system in the Republic of Kosovo” is treated with standard writing, including the introductory part and corresponding chapters. In the introductory part of the paper is emphasized the importance of the topic which is treated, with particular emphasis on the importance of judicial control in the Republic of Kosovo. This paper aims to achieve three main goals: Firstly, highlighting the importance and ways of functioning of judicial control in general, secondly, explication the method of treatment and the importance of the application of judicial control in the Republic of Kosovo and thirdly, highlighting the challenges of judicial control in the Republic of Kosovo, especially after the reorganization of the judicial system. The paper is structured as follows: introduction, general views on judicial control, including the importance of judicial control. Within the structure, important theses constitute those theses dedicated to administrative justice in the Republic of Kosovo, the legislative framework and judicial system reform in the Republic of Kosovo, including its impact on the functioning of the administrative judiciary. In the last part of the paper there are clear and consistent conclusions and significant recommendations relating to general views about judicial control, with particular emphasis on their practical implementation in the Republic of Kosovo and the way of adjustment with the reforms in the field of administrative justice which are at the beginnings of the implementation.

Recent developments in Hungarian constitutional and judicial politics have given impetus to question not only the outcomes of democratisation and Europeanisation, but also the efficacy of the European Union’s compliance mechanisms. In 2010, Hungary, one of the forerunners in building democracy made the headlines with Fidesz’s attempts at adopting a new Constitution and implementing cardinal laws along with controversial institutional, cultural, religious, moral and socio-economic policies. This article attempts to depict the transformative power of the European Union within a sensitive policy area which touches upon States’ pouvoris régaliens: the independence of the judiciary.

W artykule przeanalizowano historyczne tło ukraińskiego tworzenia instytucji jurysdykcji administracyjnej w Cesarstwie Rosyjskim i Związku Radzieckim. Określono etapy tworzenia i rozwoju jurysdykcji administracyjnej na terenie Ukrainy oraz przyczyny jej zniesienia w ZSRR. Niniejszy artykuł porusza kwestię tworzenia właściwości administracyjnej na Ukrainie, bowiem jest to zasadnicza cecha każdego demokratycznego państwa, które zapewnia prawa i wolność wszystkich osób. Instytucja jurysdykcji administracyjnej na Ukrainie przeszła długą drogę do jej powstawania. W drugiej połowie XIX wieku na Ukrainie pojawiły się badania problematyki dotyczącej rozwoju właściwości administracyjnej. Jednak brak państwowej niepodległości, całkowite zaprzeczenie właściwości administracyjnej przez władze sowieckie i inne powody uniemożliwiły powstanie tej demokratycznej instytucji w Związku Radzieckim. Dopiero po ogłoszeniu przez Ukrainę niepodległości możliwe było zmodernizowanie obecnego systemu ochrony praw człowieka przed administracją publiczną.

Historical backgrounds of Ukraine’s administrative justice creation in the Russian Empire and the Soviet Union are analyzed in the article. The stages of formation and development of administrative justice in Ukraine and the reasons for its abolishment in the USSR are de ned. The article deals with the issue of administrative justice creation in Ukraine. It is an essential feature of any democratic state which ensures rights and freedoms of all individuals are ensured. Institute of administrative justice in Ukraine has come a long way of its formation. In the second half of the nineteenth century a sign cant interest in the problems of administrative justice appeared in Ukraine. However, the lack of state independence, complete denial of administrative justice by Soviet authorities and for other reasons it was impossible to create this democratic institution in Soviet Union. Only after Ukraine proclaimed its independence it made possible to modernize the current system of human rights protection from public administration.

In the rankings conducted by the European Commission, the judicial system in Ireland was classified as the second in Europe due to the high degree of independence of the courts from other bodies. At the same time, this system, unlike in many other European countries, is strongly dispersed. Recent years have been a time of reforming the organisation of the judiciary, and the Judicial Council Act, introduced in July 2019, was supposed to solve most of the burning problems. Despite equipping the newly-established Judicial Council with a number of competences, it seems that without a thorough change of the whole system and creation of a body that would be responsible for performing at least most of the tasks related to the administration of the judiciary, the situation of judges in Ireland will not improve.

In 2018 the Warsaw Stock Exchange commissioned the Allerhand Institute, to draw up assumptions for a legislation introducing into the Polish judicial system a separate specialized Capital Market Court competent in corporate law disputes of listed companies as well as disputes between investors and issuers of financial instruments. Moreover the jurisdiction of new court would extend to embrace judicial review of decisions issued by the Polish Financial Supervision Authority (KNF). The document was prepared by Professor Arkadiusz Radwan, in cooperation with Michał Bobrzyński (Attorney-at-Law, LL.M. Harvard), legal advisor Kamil Nowak (Attorney-at-Law) and Dr. Krzysztof Grabowski – all research associates affiliated with the Allerhand Institute. This is to present an original document submitted to the Board of the Warsaw Stock Exchange on 5 December 2018.

The text presents judicial reforms of the Supreme People’s Court of China (SPC). The author argues that during a twenty-year period, the role of the SPC has underwent two major transitions. Firstly, its role of a dispute solver evolved into a designer and a leading voice of the judicial system in China. Secondly, it shifted its position from a passive implementer of laws and policies into an active public policy maker. The text also offers an insight into the SPC’s enhancement of human rights protection, efforts to establish the evidence rule system, as well as its role in promoting judicial transparency.

Доведено, що посилення правотворчої і правозастосовної роботи за цими напрямками сприятиме покращенню гарантій забезпечення права на справедливий суд на сучасному етапі.

The article deals with the simplification of court procedures and the reduction of court outlays as interconnected elements of the accessibility of justice, which directly affect the effectiveness of ensuring the right to a fair trial. It is proved that the strengthening of law-making and law-enforcement work in these areas will help to improve the guarantees of ensuring the right to a fair trial at the current stage.
