The national report for the purpose of the 20th International Congress of Comparative Law Fukuoka 2018 deals with the optional choice of court agreements from the perspective of the Czech law. The report answers the questions if the Czech national legislation allows the parties to conclude the optional choice of court agreements in international cases, what is the character of these clauses and if they are expressly stated in the Czech Private International Law Act. The authors deal also with the asysmmetrical choice of court agreements, expecially their legal effect. in the end of the report, the authors evalueate the efficiency of the national regulation and propose for the necessary modifications.

The paper deals with analysis of international judicial cooperation in criminal matters and its various institutes, subjects and basic principles. It defines the relationship between international and national law, and internal and external sovereignty of the state. It refers to the difference between international criminal law and internationalized criminal law. It states that the objectives to pursue international legal assistance in criminal matters, are the same as those of criminal law at all.

Príspevok sa zaoberá analýzou medzinárodnej justičnej spolupráce v trestných veciach a jej rôznymi inštitútmi, subjektami a základnými zásadami a princípmi. Definuje vzťah medzi medzinárodným a vnútroštátnym právom a vnútornou a vonkajšou zvrchovanosťou štátu. Poukazuje na rozdiel medzi medzinárodným trestným právom a zmedzinárodneným trestným právom. Uvádza, že ciele sledované prostredníctvom medzinárodnej právnej pomoci v trestných veciach sú v podstate rovnaké ako ciele trestného práva vôbec.

Anti-suit injunctions are rather unknown in the civil law legal system of the Czech Repbulic. The policy reasons for the rejection of anti-suit injunctions in the Czech Republic are rooted in the constitutional right of every person to assert, through the legally prescribed procedure, their rights before an independent and impartial court or, in specified cases, before another body. In other words, every person may commence proceedings before a competent court, or respectively before any court or another body (e.g. like an arbitral tribunal, etc.), which is then exclusively empowered to rule on its jurisdiction. Therefore, there is also no distinction between anti-suit injunctions in domestic and international litigation. Czech law does not have any alternative procedural or substantive devices that may have similar functions as anti-suit injunctions related to arbitration. It means that it is not possible to obtain a court order against a respondent prohibiting the respondent from commencing or continuing court proceedings in another forum in violation of an arbitration agreement.
