De-Kanting Rawls: evolutionary justifcation of the theory of justice by Ken Binmore: The article discusses the criticism of John Rawls’s theory of justice formulated by Ken Binmore. Binmore criticizes Rawls in his work for inadequate justifcation of fairness norms. In his opinion, their proper justifcation requires the rejection of Kant’s “metaphysics” in favor of Hume’s empiricism. To explain how fairness norms actually work, one must frst provide a convincing account of evolutionary processes that could lead to such norms being encoded in our genome. Secondly, it should be explained how this biological mechanism interacts with our cultural heritage and generates a selection of balance points in games that describe our social interactions

This paper presents Douglas Husak’s theory of criminalisation, which claims to be the normative standard for the construction of criminal regulations. I examine Professor Husak’s work in scholarship and journalism to show the practical application of his theory as regards the prohibition on drug possession and use. In the second part of the paper I present the Polish legal doctrine on the theory of criminalisation and compare it to Husak’s theory. My article concludes with an analysis of the judgment handed down by the Polish Constitutional Tribunal, in which the Constitutional Court expressed its position on the criminalisation of the possession and cultivation of marihuana, which I discuss in the light of Husak’s postulates on this issue.

Artykuł przedstawia teorię kryminalizacji Douglasa Husaka, która aspiruje do bycia normatywnym miernikiem zasadności regulacji prawnokarnych. W przeglądzie dorobku naukowego i publicystycznego profesora Husaka ukazane jest, jak konkretyzuje się ona w przypadku zakazu posiadania i zażywania narkotyków. W drugiej części artykułu przedstawione są dokonania polskiej doktryny na tym polu oraz przeprowadzona jest analiza porównawcza teorii Husaka i polskiej nauki. Artykuł zwieńczony jest omówieniem wyroku Trybunału Konstytucyjnego dotyczącego kryminalizacji posiadania oraz uprawy marihuany w świetle postulatów amerykańskiego naukowca.
