Budowa i utrzymanie efektywnego systemu zarządzania nieruchomościami, uzależnione jest w dużej mierze od sprawności instytucji katastru nieruchomości, któremu ustawodawca przypisał określone zadania, oraz wskazał jednoznacznie obszary w których dane ewidencyjne w nim ujawnione, stanowić winny podstawę ustalającą dla innych postępowań decyzyjnych zarówno w sferze tzw. administracji publicznej, jak i poza nią, odniesioną szerzej, np. do rynku nieruchomości i procesów z nim związanych. W tym też kontekście, w prezentowanym artykule, zdefiniowane zostały zadania, zasady oraz funkcje katastru nieruchomości, jakie pełni on zarówno w systemie prawa, w systemach zarządzania, jak i w odbiorze społecznym, jako rejestr publiczny.

Building and maintaining an effective system of property management depends largely on the efficiency of institutions of the real estate cadastre, which has specific tasks assigned by the legislator and clearly indicated areas where the cadastral data disclosed therein, shall constitute a determining basis for other decision-making procedures both in public administration circles and outside them, which is related more broadly, for example to the property market and the processes associated with it. In this context, in the presented article, were defined tasks, principles and functions of the real estate cadastre, which it is performing in law, management systems, social acceptance and as a public register.

W ostatnich latach coraz bardziej aktualne stają się kwestie dotyczące granic nieruchomości. Ma to związek z rosnącą społeczną świadomością własności, w wyniku której istotny staje się wyznaczany granicami zasięg praw do nieruchomości. Ma to znaczenie także ze względu na różnego rodzaju opłaty związane z nieruchomościami, które wynikają z parametrów działek. Wskazanie położenia granic najczęściej nie sprawia wykonawcom geodezyjnym kłopotów. W przypadku jednak, gdy działka położona jest w sąsiedztwie wody płynącej wyznaczenie granic staje się utrudnione i wymaga zastosowania algorytmów postępowania wynikających z prawa wodnego. W trakcie ich realizacji ważne są: poprawna interpretacja dokumentacji geodezyjno-prawnej oraz umiejętność połączenia wiedzy na pograniczu geodezji i hydrologii.

In the recent years issues relating to the property borders have become increasingly topical. This is related to the growing public awareness of property whereby boundaries-determined range of property rights becomes an essential issue. This is important also because of the variety of charges related to property resulting from plots. Indication of borders position usually causes no trouble for surveying contractors. If, however, when the parcel is located in the vicinity of flowing water demarcation becomes difficult and requires the use of algorithms proceeding arising out of the water rights. During their implementation these are important: the correct interpretation of geodetic and legal documentation and the ability to combine knowledge bordering geodesy and hydrology.

Cadastre is a basic form of defining a real estate in land and mortgage register. Historical backwardness in scope of developing a uniform cadastral systems throughout Poland and improper interaction between administrative body and Land and Mortgage Register Court have had an impact in the past on judicial decisions concerning documentation that may form the basis of defining a real estate in land and mortgagee register. The purpose of this article is to show current development of the cadastre in Poland and to propose conclusions for interpretation of law on land and mortgage register and to conclude de lege ferernda postulate concerning cadastre and land and mortgage register.

In the presented article a legal issue was shown regarding the possibility of introducing into the Polish legal system a concept of three-dimensional real estate (aerial parcel) and the need to define more precisely the spatial limits of property rights. This issue was presented against the background of legal system solutions in this field existing in the USA, Sweden and Norway. The need for new institutional arrangements was preceded by a discussion of current enrollment policy in Poland of the separate ownership of buildings and the establishment of rights for their usage. Article also includes comments on the necessity of building a multi-dimensional real estate cadastre, enabling registration of spatially separated objects (including, in particular, buildings, structures, premises and other building objects and technical infrastructure) and all rights associated with them, and their visualization in three dimensions.

W prezentowanym artykule przedstawione zostało zagadnienie prawne dotyczące możliwości wprowadzenia do polskiego obiegu prawnego pojęcia trójwymiarowej nieruchomości (działki powietrznej), jak i potrzeby dookreślenia przestrzennych granic prawa własności. Problematyka ta zaprezentowana została na tle obowiązujących w USA, Szwecji i Norwegii, rozwiązań systemowych w tym zakresie. Konieczność wprowadzenia nowych instytucjonalnych rozwiązań poprzedzona została omówieniem obowiązujących obecnie w Polsce zasad rejestrowania odrębnej własności obiektów budowlanych i ustanawiania praw do ich użytkowania. Przedstawione zostały również uwagi dotyczące konieczności budowy katastru wielowymiarowego, umożliwiającego rejestrację wyodrębnionych przestrzennie obiektów ewidencyjnych (w tym w szczególności budynków, budowli, lokali i innych obiektów budowlanych oraz urządzeń infrastruktury technicznej), a także wszelkich praw z nimi związanych, oraz ich wizualizację w układzie trójwymiarowym.
