Coraz większe kontrowersje i zaniepokojenie polityków wielu państw europejskich wzbudza dynamika i struktura chińskich bezpośrednich inwestycji zagranicznych (BIZ) napływających do Europy. Nieudane próby powstrzymania przez niektóre państwa (np. Niemcy, Wielka Brytania) przejęć i fuzji w strategicznych sektorach gospodarki nasiliły dyskusję na temat BIZ i konieczności ustanowienia mechanizmów powstrzymania transakcji niekorzystnych z punktu widzenia bezpieczeństwa i porządku publicznego kraju przyjmującego. Celem artykułu jest pokazanie złożoności tego problemu w świetle ekspansywnej polityki inwestycyjnej Chin będącej częścią nowej strategii „Made in China 2025” i rozbieżnych interesów państw członkowskich. Dla zilustrowania zjawiska dokonano przeglądu chińskich inwestycji zagranicznych w Unii Europejskiej w latach 2000-2016. Szerzej omówiono inwestycje w Niemczech z uwagi na to, że w 2016 roku stały się one głównym odbiorcą inwestycji chińskich w Europie. Przeanalizowano obowiązujące i projektowane regulacje na szczeblu unijnym odnoszące się do inwestycji bezpośrednich państw trzecich na terenie UE oraz stanowiska, jakie zajęły wobec nich państwa członkowskie UE, jak również rozwiązania stosowane w wybranych państwach członkowskich. W artykule zastosowano metodę przeglądu literatury oraz materiałów źródłowych, a ponadto analizę statystyczną i porównawczą.

The dynamics and structure of Chinese foreign direct investment (FDI) flowing to Europe have fuelled controversy and concern among politicians in many European countries. Unsuccessful attempts by governments in member states to withhold takeovers in strategic sectors of economy have raised discussion on FDI and the need to establish mechanisms to stop unfavourable transactions. The aim of the paper is to show the complexity of this problem in the light of China’s new expansive investment policy and divergent interests of the EU member states. To illustrate the phenomenon, Chinese FDI in the EU was reviewed in the years 2000-2016. Chinese investment in Germany has been discussed in more detail as in 2016 this country was a favourite destination for Chinese investors in Europe. The review provided an analysis of the existing and proposed regulations at the EU level regarding direct investment of third countries in the EU and positions taken by the EU member states. In the paper the methodology of literature review and source material, as well as statistical and comparative analyses were used.
