Aksjologia samorządu terytorialnego – in rebus angustis?

Territorial self-government is an important element of the organisation and functioning of contemporary democracies. At the same time it is a phenomenon of particularly complex axiology showing many multi-layered axiological connotations. In this paper the recent changes to the Polish legal order have been analysed. More specifically, the analysis concerns the implication of the crucial features of the territorial government: the institutions that guarantee self-governance and independence. A special focus has been given to legal regulations in the area of structural administrative law in the part applicable to the territorial self-government. Amendments to provisions of universal applicability have only been identified. The conclusions of the above analysis,not very optimistic indeed, have been complemented with some  recommendations of what would need to be done in order to maintain or restore the hitherto existing level of decentralisation of public power in the sphere of self-government.

Samorząd terytorialny stanowi kluczowy element organizacji i funkcjonowania współczesnych demokratycznych państw prawnych. Jest zarazem zjawiskiem szczególnie wrażliwym aksjologicznie – wykazuje wieloaspektowe konotacje w tym zakresie. W artykule poddano analizie ostatnie zmiany polskiego porządku prawnego – in concreto z punktu widzenia ich wpływu na kluczowe atrybuty samorządu terytorialnego, tj. instytucje służące urzeczywistnianiu samorządności i samodzielności. Uwagę skoncentrowano na wprowadzanych regulacjach prawnych z zakresu ustrojowego prawa administracyjnego – w zakresie unormowań dotyczących samorządu terytorialnego. Natomiast sygnalizacyjnie potraktowano zmiany odnoszone do przepisów o systemowym (uniwersalnym) zastosowaniu. Niezbyt optymistycznym konkluzjom towarzyszą postulaty wskazujące na kluczowe wymagania, jakie należałoby spełnić, by – przynajmniej – zachować/przywrócić dotychczasowy stan decentralizacji władzy publicznej w sferze samorządu terytorialnego.
