The draft resolution concerns the issue of enforcement officer’s collection of enforcement costs in another enforcement proceedings after their final determination. The author of the commentary critically refers to the statement that the costs of enforcement for to the court enforcement officer, established by a valid order, do not benefit from the priority provided for in Article 1025 § 1 Item 1 of the Code of Civil Procedure in another enforcement proceeding.

Glosowana uchwała dotyczy kwestii pobierania przez komornika sądowego kosztów egzekucyjnych w innym postępowaniu egzekucyjnym po ich prawomocnym ustaleniu. Autor glosy krytycznie odnosi się do stwierdzenia, że koszty egzekucji należne komornikowi sądowemu, ustalone prawomocnym postanowieniem, nie korzystają z pierwszeństwa przewidzianego w art. 1025 § 1 pkt 1 k.p.c. w innym postępowaniu egzekucyjnym.
