Celem i sensem działalności dziennikarskiej jest dostarczanie informacji i sprawowanie kontroli społecznej przez krytykę prasową. Działalność dziennikarska stanowi mechanizm kontrolny istotny dla prawidłowego funkcjonowania demokratycznych struktur. Krytyka prasowa, chociaż cenna i pożądana, nie jest jednak wartością absolutną, ma granice, po przekroczeniu których stanowi nadużycie swobody wypowiedzi. Wyznaczenie granic krytyki prasowej in abstracto jest bardzo trudne, niemniej jednak konieczne ze względu na ochronę innych dóbr i wartości.

The main aim and meaning of journalistic activity is to providing information and use journalistic criticism as tool of social control. Journalistic activity is an important control mechanism that contributes to the proper functioning of democratic structures. Criticism of the press, although valuable and desirable, is not an absolute value. It has its limits, beyond which is an abuse of freedom of expression. Limitations for criticism of the press in abstracto is very diffi cult, but it is also necessary to protect other goods and values.

This article analyzes the penal provisions of the press law when considering the issue of responsibility for the publication of press material. It presents the cases of the notification of the violation of press law, joint and several responsibility of the press, contratyp of press criticism, satire, cartoons and press reports, the limitation of liability of the press, the question of exerting pressure on journalists and on press criticism, press publishing without registration, avoiding the publication of official announcements and arrest warrants, distribute materials of the case, a crime of an admission to the publication, as well as some questions relating to the proceedings for violation of press law.
