In popular parlance the Star Wars universe often serves as an example of a binary division between good Rebels and evil Empire. However, a detailed legal analysis of the turbulent political and legal history of the good old Republic and its transformation into the Empire casts doubts on this popular opinion. The Republic seems to be a degenerate system, based on exploitation of the weak, slavery and dominance of the military order (the Jedi), exercising power without any democratic control. Surprisingly, the transformation of the Republic into the Empire was formally admissible, and backed up by republican constitutional principles. Moreover, it has been purported here that the political system of the galaxy had very strong feudal relics and allowed both for vendettas and the right to rebel against the goverment. The Rebellion was in fact a counterrevolutionary movement whose main goal was to re-establish the ancient regime and anihilate the last two representatives of the schismatic Jedi sect (the Siths), while the Empire was trying to establish a ruthless, but effective system of government. Thus, what we have here is not a battle of Good against Evil but simply a civil war between conservative terrorists and authoritarian reformers. Surprisingly, a short-lived victory of the Rebellion leads to a social and economic crisis, while the restoration of the Empire by the New Order guarantees stability of the economic and political system. Moreover, imperial feuds and vendettas impact only the major players, while the commoners are not directly affected.

The aim of the article is an attempt to analyze the problem of punishment in the Leo Tolstoy’s novel – Resurrection. The topic was examined from the perspective of hermeneutic circle, which allowed, by reference to the literary work, biography of the writer, and the epoch when he lived, to show how the problem of punishment is significant in his work. Tolstoy, whose basic law of human life is the mutual love between people, completely rejects the meaningfulness of the penitentiary system.

The ethos of the lawyer in western societies is mainly founded on a culture of the Enlightenment. In effect, it tends to treat law in a purely rational and instrumental manner. The Law and Literature movement, as opposed to this traditional approach, searches for lost dimensions of the lawyer’s ethos, trying to discover interpretative, rhetoric and narrative aspects in the practice of law.

In this paper I discuss the apparent similarities between the “literate approach” and the aspiring “visual media approach”. Then, I scrutinize arguments for utility of the second approach. It seems that even though both approaches are founded on similar humanistic considerations, they are nonetheless separate positions; thus the need to justify the application of the second approach independently of the first. As an important task in due course I consider debunking the arguments in support of accusations of the “law and film” movement of being a threat to law and its legitimacy (as related to the “law going pop” argument by Richard K. Sherwin).

W niniejszym artykule rozważam rzekome podobieństwa pomiędzy metodologią „studiów literackich w prawie” a metodologią „mediów wizualnych w prawie”. Następnie poddaję ocenie argumenty na rzecz przydatności drugiego z tych podejść. Wygląda na to, że choć oba podejścia nawiązują do podobnych podstaw humanistycznych, to stanowią jednak stanowiska oddzielne. To rodzi potrzebę, aby uzasadnić wartość „mediów wizualnych w prawie” niezależnie od uznania wartości „studiów literackich w prawie”. Rozważam w szczególności zasadność oskarżeń pod adresem ruchu „prawa i filmu” jako zagrożenia dla prawa i jego autorytetu (w odniesieniu do argumentacji Richarda K. Sherwina o „popularyzacji prawa”).

Law and Literature movement belongs among today’s critical legal-philosophical movements. This movement springs out from idea that law can be treated as a language, including its literary form. Therefore, it understands the law as a cultural artifact that can be subjected to the same or comparable research as any other literary text. At present, this approach mainly operates with methods that can help general legal methodology and specific methodology the interpretation of legal texts. The article “Law and Literature: Brno connection” focuses on the description of the movement, with an emphasis on the current trends in the field (which have its origin and context, which can not be overlooked), especially taking into account the direction of “Law as Literature” and taking into account the possibility of adapting this direction to the Czech legal environment. The article focuses on the possibilities of using literary interpretation in law (context analysis, including overinterpretation, audience analysis, narratology) and the potential effects of literature on law (persuasion, cultivation). Deeper interest in this issue is evident at the Faculty of Law of Masaryk University so this research institute cannot be passed over. The article therefore represents the findings realized at Brno Faculty as the most prominent workplace in this field and shows the existing research findings in this segment of law examination.

Law and Literature (Právo a literatura) řadíme mezi současná kritická právněfilosofická hnutí. Vychází z představy práva jako jazyka, který může mít i literární podobu, a chápe proto právo jako kulturní artefakt, který může být podroben stejnému či srovnatelnému zkoumání jako jakýkoli jiný literární text. V současnosti tento přístup operuje zejména s metodami, které mohou napomoci právní metodologii obecně, nebo přímo napomoci metodám interpretace právních textů. Článek se proto soustředí na popis hnutí s důrazem na současné trendy v této oblasti (které však mají svůj původ a svůj kontext, což nelze pominout), zejména s přihlédnutím k směru „Právo jako literatura“ a s přihlédnutím na možnosti adaptace tohoto směru na české právní prostředí. Soustředí se proto na možnosti využití literární interpretace v právu (analýza kontextu, včetně nadinterpretace, analýza publika, naratologie) a vůbec potenciální vlivy literatury na právo(přesvědčování, kultivace). Hlubší zájem o tuto problematiku je patrný na Právnické fakultě Masarykovy univerzity. Článek proto představuje dosavadní zjištění učiněné na brněnské fakultě jako pracovišti s nejvýraznějším postupem v této oblasti a ukazuje dosavadní badatelská zjištění v tomto segmentu zkoumání práva.

The article is the result of interdisciplinary research into the legal aspects of Czesław Miłosz's biography and work. It presents the legal identity of Czesław Miłosz, which is somewhat forgotten by the general public, by referring to his studies and graduation from law school as well as by searching for legal traces and clues in the selected works of the Nobel Prize winner. The present text is based on historical, literary as well as philosophical and legal research. It not only examines the biography of the Nobel Prize winner, but also asks questions concerning the possibility of interpreting his literary works by employing a philosophical and legal reflection as well as using the approach of post-analytic philosophy of law, including the achievements of the field of legal and literary studies. It also constitutes a study of legal education at the Stefan Batory University in Vilnius in the interwar period.

Artykuł jest rezultatem interdyscyplinarnych badań nad prawniczymi aspektami biografii i twórczości Czesława Miłosza. Przybliża nieco zapomnianą w powszechnym odbiorze prawniczą tożsamość Czesława Miłosza, nawiązując do ukończenia przez niego uniwersyteckich studiów prawniczych, a także poszukując tropów prawnych w wybranych utworach noblisty. Praca opiera się na przeprowadzonych badaniach historycznych, literaturoznawczych i filozoficznoprawnych. Bada nie tylko biografię noblisty, ale również stawia pytania o możliwość interpretacji jego dzieł literackich przy zastosowaniu refleksji filozoficznoprawnej, wykorzystując podejście postanalitycznej filozofii prawa, w tym dorobek kierunku badań prawno-literackich. Stanowi także studium edukacji prawniczej na Uniwersytecie Stefana Batorego w Wilnie w okresie międzywojennym.

Abstract: In this paper we examine translation arising in court cases involving reputational damage. A diachronic and tightly focused cross-jurisdictional selection of examples from case law is used to highlight the range of ways in which translation can be employed, blamed, or relied upon by the parties and by the courts, and we glimpse how translations can be a source of libel, a defence against libel, or a gateway to libellous material, how crucial translation can be in protecting or damaging reputations, and how significantly it can affect a case’s outcome. We apply Engberg’s lens for communication in legal contexts, distinguishing micro, meso and macro occurrences of translation at publisher/business/individual, judicial, and State levels. Recurring translation-related topics either mooted by courts or arising in our analysis are then outlined, including: competing translations; translation techniques; translator identification; online translation; how the acceptance of jurisdiction may be influenced by translation requirements; and how judges approach decision-making when foreign language documents and translation are involved.
