In the research the legal status of the legal guardian appointed on the basis of the Article 26 of the National Court Register Law was analyzed. This legal entity involves many aspects related to public law. First of all, the role of the legal guardian is to secure the public interest. Legal guardian seems to be more of a public authorities representative in the company than just a representative of a company. The same role is appointed to the legal guardian on the basis of the 42 Article of Polish Civil Code. The guardian cannot represent a legal person, but is entitled to perform specific actions. This leads to a conclusion that the Family and Guardianship Code (Article 165 and subseq.) cannot be applied. The undertaken research enables to draw a conclusion that conventional acts of a certain entity are said to be a constitutive rule of those actions. On the basis of the court verdict another entity acquires the competence. Article 26 and subseq. of the National Court Register Law should be perceived as statements on other legal provisions that constitute rules of sense of conventional acts.

Kuratela rodzinna, która w Polsce ma prawie stuletnią tradycję, zawsze była ściśle związana organizacyjnie i funkcjonalnie z sądownictwem rodzinnym. Od roku 2002 organizację, zakres uprawnień i obowiązków, samorządność oraz odpowiedzialność dyscyplinarną kuratorów określa ustawa o kuratorach sądowych. Kandydaci do wykonywania zawodu kuratora muszą spełniać określone w ustawie wymogi i mieć wyższe wykształcenie kierunkowe, a przed dopuszczeniem do wykonywania zawodu muszą odbyć roczną aplikację i zdać egzamin zawodowy. Kuratorzy są funkcjonariuszami publicznymi i zawodem zaufania publicznego, stąd w ich pracy istotne znaczenie ma profesjonalizm oraz wysoka kultura zawodowa. Kuratorzy rodzinni nadzorują wykonanie postanowienia sądu przez osoby, których ono dotyczy. Ich rola nie ogranicza się jednak do kontrolowania wykonania orzeczenia – ustawodawca mówi, że kuratorzy wykonują też zadania o charakterze wychowawczo-resocjalizacyjnym, diagnostycznym i profilaktycznym. Często są pierwszym profesjonalistą, który pomaga rodzinie zmienić sposób jej dotychczasowego funkcjonowania i angażuje inne służby społeczne do tego działania. Celem artykułu jest przedstawienie najistotniejszych informacji o zawodzie kuratora sądowego i praktyce jego wykonywania.

In Poland, guardianship has almost a hundred years of tradition and has always been closely linked to the family court organizationally and functionally. Since 2002, the institution, its scope of power and duties, its self-governing and the disciplinary responsibility of legal guardians have been defined by the regulation on legal guards. Candidates for the position of the guardian must meet the requirements set out in the legal system and hold a higher education degree. After completing the annual apprenticeship and passing the vocational examination, candidates are allowed to perform the profession. Legal guardians are public officials and a profession of public trust so professionalism and high professional culture are important in their work. Guardians supervise the execution of court orders by persons concerned. However, their role is not limited to verifying the execution of the sentence – the legislator states that guardians also carry out tasks of educational, social, diagnostic and preventive nature. Legal guardians are often the first professionalpeople to help the family change the way it functions and engage other social services to do so. The issues taken in this article concerned presenting the most important aspects of legal guardian’s profession.
