On January 24, 2019, the Court of Justice of the European Union (CURIA) issued a judgment on the basis of a request for a preliminary ruling, concerning the interpretation of Art. 1 of Regulation (EU) No. 1231/2010 of the European Parliament and of the Council of 24 November 2010 extending the basic and executory regulation to third-country nationals who are as yet not covered by these regulations, and here solely because of their nationality. The aim of this study is to present a comprehensive interpretation along with the relevant legal provisions of the arguments expressed by the Court of Justice of the European Union in the case Balandin and others, C-477/17.

24 stycznia 2019 r. Trybunał Sprawiedliwości Unii Europejskiej wydał wyrok na podstawie wniosku o wydanie orzeczenia w trybie prejudycjalnym. Wyrok dotyczył wykładni art. 1 rozporządzenia Parlamentu Europejskiego i Rady (UE) nr 1231/2010 z dnia 24 listopada 2010 r. rozszerzającego rozporządzenie podstawowe i wykonawcze na obywateli państw trzecich, którzy nie są jeszcze objęci tymi rozporządzeniami jedynie ze względu na swoje obywatelstwo. Celem niniejszego opracowania jest przedstawienie kompleksowej wykładni i właściwych przepisów prawa w tym zakresie oraz zapoznanie czytelników artykułu z argumentacją Trybunału Sprawiedliwości Unii Europejskiej wyrażoną w sprawie Balandin i in., C-477/17.
