L’articolo si propone di ricreare il sistema di norme del diritto internazionale e dell'UE riguardanti la protezione del clima in materia di riduzione delle emissioni di gas a effetto serra dovute all’agricoltura e, di conseguenza, di definire i requisiti giuridici per l'agricoltura come settore incluso nello sforzo in oggetto. Al giorno d’oggi, non esiste una regolazione settoriale distinta in materia, a livello internazionale o dell'UE. Tuttavia, si può notare che l’argomento è sempre più presente negli accordi internazionali (con l'accordo di Parigi in primo piano), nei documenti strategici riguardanti la politica climatica ed energetica dell'UE, nonché nel diritto derivato dell'UE. Il 2020 costituisce un punto di svolta, in quanto i periodi di rendicontazione vengono riassunti e chiusi, vengono inoltre pianificate e costruite nuove iniziative per il clima (soprattutto nell'ambito del Green Deal europeo). Tutto ciò testimonia di una crescente importanza e di uno sviluppo dinamico, come d’altronde da prognosi, di questo campo normativo, il che si traduce anche in un progressivo cambiamento ideologico, il quale riguarda le potenzialità del settore agricolo da sfruttare nella lotta a favore del clima, in particolare nella riduzione delle emissioni di gas a effetto serra dovute all’agricoltura.

The aim of the considerations was to reconstruct the system of international and EU climate protection law standards for the reduction of greenhouse gas emissions from agriculture and, consequently, to define the legal requirements for agriculture as a sector included in the reduction efforts carried out in this area. Currently, neither at the international nor at the EU level, is there a separate sector-specific regulation on this issue. However, this issue has been more and more frequently included in international agreements (with the Paris Agreement at the forefront), in strategic documents pertaining to the EU climate and energy policy, as well as in secondary EU legislation. The year 2020 is a crucial period in which the summaries and closures of reporting periods and the planning and building of new climate actions (especially within the European Green Deal) are taking place. This indicates the growing importance of climate regulations and their projected dynamic development, which also reflects an advancing ideological change regarding the potential of the agricultural sector in climate actions, particularly in respect of the reduction of greenhouse gas emissions from agriculture.

Celem rozważań jest odtworzenie systemu norm międzynarodowego i unijnego prawa ochrony klimatu dotyczących redukcji emisji gazów cieplarnianych pochodzenia rolniczego, a w konsekwencji określenie wymogów prawnych dla rolnictwa jako sektora włączonego do wysiłku redukcyjnego w tym zakresie. Obecnie ani na poziomie międzynarodowym, ani unijnym nie ma osobnej, sektorowej regulacji dotyczącej tego zagadnienia. Można jednak zauważyć włączanie tej tematyki zarówno do umów międzynarodowych (z porozumieniem paryskim na czele), dokumentów strategicznych w ramach unijnej polityki klimatyczno-energetycznej, jak i aktów prawa wtórnego UE. Rok 2020 jest przełomowym okresem, w którym następują podsumowania i zamykanie okresów sprawozdawczych oraz planowanie nowych działań na rzecz klimatu (zwłaszcza w ramach Europejskiego Zielonego Ładu). Wskazuje to na rosnące znaczenie i prognozowany rozwój tej dziedziny regulacyjnej, co odzwierciedla postępującą zmianę ideologiczną co do potencjału sektora rolniczego w działaniach na rzecz klimatu, a w szczególności redukcji emisji gazów cieplarnianych pochodzenia rolniczego.
