In his article, the author presents an analysis of the provisions of Article 11a of the Act on the Supreme Audit Office. This regulation sets forth the right of legislative inspiration, namely a normative construct that allows to inspire other bodies in the area of legislative activities. The article presents the essence of legislative inspiration, especially as compared to other notions related to launching of legislative works. It also discusses the provision of Article 11a of the Act from the perspective of the way in which it allows for influencing a potential legislative process. The article depicts two aspects: the formal aspect (that refers to the proceedings aimed at formulating a legislative proposal) and the material aspect (that refers to the subject matter of the outcome of the activities that constitute the execution of the right of legislative inspiration).

Instytucja inicjatywy ustawodawczej jest kluczowym elementem procesu legislacyjnego, bowiem to ona rozpoczyna prace legislacyjne, których efektem końcowym ma być uchwalenie ustawy. Pojęcie to zostało szczegółowo omówione w doktrynie prawa konstytucyjnego, dlatego w niniejszym artykule zwrócono szczególną uwagę na etap prelegislacyjny, który nie jest tak szeroko analizowany w nauce prawa. Podjęto próbę rozróżnienia pojęcia inspiracji ustawodawczej od inicjatywy ustawodawczej. W tym celu zastosowano metodę dogmatyczno – prawną, polegającą na analizie przepisów prawnych. Na podstawie przepisów konstytucyjnych wskazano podstawowe cechy inicjatywy ustawodawczej, a na podstawie przepisów różnych ustaw określono jakie podmioty i w jaki sposób mogą próbować inspirować właściwe organy do wniesienia projektu ustawy do Sejmu.

The institution of legislative initiative is a key element of the legislative process, because it starts legislative works. This concept has been widely discussed in the doctrine of constitutional law and it is a reason why in this article has been paid special attention to the pre-legislative stage. An attempt was made to distinguish the concept of the legislative inspiration from the legislative initiative. Basic features of a legislative initiative have been identified on the basis of constitutional provisions. Entities and ways to inspire the relevant bodies (which are able to bring a draft of the bill to the Sejm) have been determined under the provisions of various laws.

The Supreme Audit Office of Poland, while evaluating the activities of public bodies, takes into account the factors that influence the way they perform the tasks they are entrusted with. NIK can conclude that it is necessary tomake changes tothe binding regulations and recommend that these changes should be introduced. In his article, the author analyses the possibilities that NIK has toimpact the legislative process, including formulation of de lege ferenda proposals. In the opinion of the author, Article 11(a) of the Law on NIK does not provide for the mandate toformulate de lege ferenda proposals, yet it allows for taking measures aimed at implementation of the recommendations that NIK elaborated previously.

Najwyższa Izba Kontroli, oceniając działalność organów publicznych, bierze pod uwagę czynniki, które wpływają na sposób realizacji powierzonych im zadań. Izba może stwierdzić konieczność zmian obowiązujących przepisów i postulować ich wprowadzenie. W artykule dokonano analizy możliwości oddziaływania Izby naproces ustawodawczy, w tym formułowania wniosków de lege ferenda. W ocenie autora artykuł 11a ustawy o NIK nie upoważnia do kierowania nowych wniosków w sprawie zmiany prawa, ale pozwala podejmować działania służące realizacji wcześniejszych.
