The article constitutes an overview. It provides a synthetic description of the current state of research and the directions for the development of the thought which is focused on the issue of the language of the regulations and legal norms, as well as the language of the legal theory and practice, in the previous century starting from the thirties. Therefore, the most important linguistic and jurisprudential publications were selected which, then, were discussed simultaneously, in a chronological order. These considerations allowed to organize what by 1999 had occurred in the reflection on the legislative language and the legal language in separate academic fields, which, after being combined, laid the foundations for jurislinguistics.

W niniejszym artykule dokonana została analiza logiczno-semantycznej struktury zdań sformułowanych w języku prawnym z językoznawczego punktu widzenia. Po pierwsze, zbadano jakie elementy służą wyrażaniu znaczenia w tekstach ustawowych. Omówiono następujące elementy normotwórcze: modalność prawnicza, podmiot normy, czyn, warunki stosowania, czas i miejsce, władza normotwórcza i negacja. W drugiej części artykułu dokonano analizy relacji logiczno-semantycznych zachodzących pomiędzy tymi elementami. Zgodnie z teorią Browersa (1989) te relacje logiczno-semantyczne są reprezentowane przez strukturę predykatywno-argumentatywną na różnych poziomach.

This article analyses the logical-semantic structure of legislative sentences from a linguistic point-of-view. First, it is examined which elements constitute the meaning of legislative sentences. The following norm elements will be discussed: legal modality, norm subject, act, conditions of application, time and space, norm authority and negation. In the second part of the article, the logical-semantic relations between these elements are analysed. Following Bowers (1989), these logical-semantic relations are represented in a predicate-argument structure on different levels.

The article presents the subjectivity of semantic signs of the legislative language as images of reality in a statutory instrument. The author presents a semantic and pragmatic analysis of the meaning and communicative function of language signs taking into account the techniques of expressing meanings in legal provisions. The analysis of grammatical structures and style of statutory instruments reveals the artificiality of references of terms, attributes and syntactical structures expressing cause and effect relations in expressions typical of the legislative language and conveying connoted messaged in a non-verbatim way.

Artykuł prezentuje przedmiotowość wytworów semantycznych języka prawnego jako obrazów rzeczywistości w akcie ustawodawczym. W aspekcie semantyczno-pragmatycznym autorka analizuje treść znaczeniową i funkcję komunikacyjną znaków językowych ze względu na technikę wyrażania ich treści w przepisach prawnych. Analiza struktur gramatycznych i stylu tekstu prawnego wykazała, na czym polega sztuczność odniesień terminów, określeń i konstrukcji składniowych służących obrazowaniu przyczyny i skutku w wyrażeniach charakterystycznych dla języka prawnego, rozumianych nie wprost, czyli przekazujących implikowane treści niedosłownie.

The article is a linguistic lecture on mutual relations between legal language and legislative language on the semantic, syntactic, pragmatic and stylistic planes. The author analysed decisions and official regulations with regard to the status of language as well as the linguistic understanding of communication. A decisive official act is a testimony of the primary reading of the text of a legislative act by an official, fulfilling the role of an interpreter and a decision maker in applying law. He fulfils a duty imposed on him by the norm of competence, verbalised in principles of legal acts. In the process of organizing a legal text, he makes use of the rules of language, according to both the studied and the statutorily recommended rules of the interpretations of law. Through evoking the content of legal articles in official documents, therefore through concretization of legal norms in the process of reception, the legal meanings and contexts undergo a certain kind of assimilation by an official-interpreter. Later, they become adapted in corresponding legal situations, and finally, as a consequence, a process of universalization of knowledge about the established law takes place, because an official-decision maker inscribes his personal knowledge of the legislative content into a specific legal reality of his own community.

Artykuł jest wykładem językoznawczym na temat wzajemnych związków między językiem prawnym a językiem prawniczym na płaszczyźnie semantycznej, syntaktycznej, pragmatycznej i stylistycznej. Autorka dokonała analizy decyzji i zarządzeń administracyjnych ze względu na status języka i lingwistyczne rozumienie komunikacji. Stwierdziła, że decyzyjny akt urzędowy jest świadectwem twórczego odczytania macierzystego tekstu ustawy przez urzędnika pełniącego rolę interpretatora i decydenta w stosowaniu prawa. Urzędnik wypełnia obowiązek narzucony mu przez normę kompetencyjną wysłowioną przepisami w aktach prawnych. Posiłkuje się regułami języka według wyuczonych i ustawowo zalecanych reguł wykładni prawa. Poprzez ewokację w odbiorze treści artykułów ustawy w dokumentach administracyjnych znaczenia i konteksty prawne ulegają swoistemu przyswojeniu przez urzędnika-interpretatora. Następnie podlegają adaptacji do odnośnych sytuacji prawnych, a w konsekwencji następuje proces uniwersalizacji wiedzy o prawie stanowionym, ponieważ urzędnik-decydent wpisuje indywidualną znajomość treści ustawodawczych w konkretną rzeczywistość prawną własnej wspólnoty komunikacyjnej.
