The constitutional right to the court is the right to effective legal protection. It may be exercised if the law provides for the legal measures to ensure enforceability of the judgments. Local law enacted by the local government authority constitutes the source of universally binding law. Polish administrative courts exercise the control over hierarchical compatibility of a local legal act with the higher-order acts. This control is of comprehensive character, as the administrative court is not bound by the objectives indicated in the complaint, nor by the legal basis presented by the complainant. If the complaint against an act of local law is accepted, the administrative court renders its judgment declaring this act invalid. Frequently, a local law act which is invalidated constitutes the legal basis for an administrative decision (tax decision) or an order. Therefore, the enforcement of the judgment of the administrative court declaring a local law act invalid relates to an individual act. The legislator indicated that such acts may be challenged in accordance with the procedure determined in the administrative proceedings or specific proceedings. The author formulates and justifies the thesis that the most appropriate procedure of the enforcement of the described court ruling in the case of a specific decision is the reopening of the administrative proceedings (tax proceedings).

The paper presents the issue of the municipal program of care for and prevention of homeless animals set out in Article 11a of the Act of 21 August 1997 on animal protection in the context of the possibility of ascribing to it the features of a local law act. The issue of correct qualification of the municipal program of care for homeless animals and prevention of homelessness and the realization of statutory norms authorizing to issue this act by the local legislator is an extremely important issue due to possible legal consequences in the form of invalidation of a resolution of a local government body with ex tunc effect. The author of the article focused in the first part on the characteristics of such a form of local government action as the act of local law, considering its characteristics on the basis of the provisions of law, doctrine and judicature. In the second part the author assessed the municipal program of care for homeless animals and prevention of homelessness through the prism of features characterizing the act of local law. The aim of the paper was to review and discuss essential features of the local law acts and to qualify the communal programme of care for homeless animals and homelessness prevention as the local law act against the background of the court decisions

W artykule przedstawiono zagadnienie gminnego programu opieki nad zwierzętami bezdomnymi oraz zapobiegania bezdomności określonego w art. 11a ustawy z dnia 21 sierpnia 1997 r. o ochronie zwierząt, w kontekście możliwości przypisania mu cech aktu prawa miejscowego. Problematyka prawidłowej kwalifikacji gminnego programu opieki nad zwierzętami bezdomnymi, zapobiegania bezdomności oraz realizacja ustawowej normy upoważniającej do wydania tego aktu przez lokalnego prawodawcę jest zagadnieniem niezwykle istotnym ze względu na możliwe konsekwencje prawne w postaci stwierdzenia nieważności uchwały organu stanowiącego jednostki samorządu terytorialnego ze skutkiem ex tunc. Autor artykułu skupił się w pierwszej jego części na charakterystyce takiej formy działania organów samorządu terytorialnego jak akt prawa miejscowego, rozważając jego cechy na podstawie przepisów prawa, wypowiedzi doktryny oraz judykatury. W kolejnej zaś dokonał oceny gminnego programu opieki nad zwierzętami bezdomnymi oraz zapobiegania bezdomności przez pryzmat cech charakteryzujących akt prawa miejscowego. Celem artykułu był przegląd i omówienie istotnych cech aktów prawa miejscowego oraz kwalifikacja gminnego programu opieki nad zwierzętami bezdomnymi oraz zapobiegania bezdomności jako aktu prawa miejscowego na tle orzecznictwa sądowego.

The article presents the basic issues concerning the legal solutions contained in the on the Realization of Social Services by the Social Services Center Act. This legal act provides new tasks for municipalities concerning the creation of new organizational units of the commune i.e. social service centers. The aim of the this legal solutions is to develop and integrate the social services system at the local level. Establishing a social service center (CUS) is not an obligatory task of the commune. Therefore the question arises if the creation of the new organizational units would be related to the financial issues of the commune. Probably the communes would also take into the account the fact that in many of them have been running the social service centers targeted at specific social groups, usually seniors or disabled people for several years.
