W niniejszym tekście przedstawiona została problematyka z zakresu kanonicznego prawa karnego odnosząca się do kary wydalenia ze stanu duchownego. Wykorzystane zostały źródła prawa kanonicznego oraz literatura z zakresu kanonistyki. Opracowanie zostało podzielone na cztery części. Pierwsza z nich ukazuje sposoby utraty stanu duchownego zawarte w kan. 290 KPK/83, które zostały wymienione i krótko opisane. W tej części została również omówiona kara wydalenia ze stanu duchownego przewidziana w katalogu kar ekspiacyjnych, zawartym w kan. 1336. Następnie przedstawiono przestępstwa zagrożone karą wydalenia ze stanu duchownego, wprowadzając rozróżnienie na sprawy rozpatrywane przez ordynariusza miejsca oraz zarezerwowane Kongregacji Nauki Wiary. W kolejnej części wskazane i opisane zostały sposoby wymierzania omawianej kary. Ostatnia cześć przedstawia skutki wymierzenia kary wydalenia ze stanu duchownego.

This text presents issues concerning the canon of criminal law relating to the punishment of dismissal from the clerical state. Sources of canon law and literature in the field of canon law were used. The considerations have been divided into four parts. The first shows the manner of the loss of the clerical state mentioned in can. 290 of the 1983 Code of Canon Law, which are listed and briefly described. This section also discusses the penalty of dismissal from the clerical state provided in the directory expiatory penalties contained in can. 1336 of 1983 Code of Canon Law. This is followed by the offences punishable by dismissal from the clerical state by distinguishing the cases dealt with by the local ordinary, and those reserved the Congregation for the Doctrine of the Faith. In the next part methods of measurement of the discussed punishment are highlighted and described. The last part presents the effects of the punishment of dismissal from the clerical state.
