Mecanismos de democracia en México: la iniciativa ciudadana y popular en la legislación

El mecanismo de la iniciativa activada por ciudadanos para formar leyes se contempla desde 1996 en la legislación subnacional, y desde el 2014 en la Constitución Política de los Estados Unidos Mexicanos. La tensión entre participación directa y modelos representativos para la toma de decisión en el diseño del Estado moderno ha sido un debate constante (Resnick 2007: 77–80). ¿Cuáles son las reglas que la legislación establece para disparar los mecanismos de iniciativa popular y ciudadana en México? ¿Cómo funciona la activación de iniciativas en la democracia mexicana? Las iniciativas no forman parte de los procesos de deliberación en la hechura de leyes, ni son vinculantes, ni determinan la redacción final de los documentos aprobados ¿Para qué sirven? Permiten incorporar temáticas en las agendas legislativas y confiar en la voluntad de los legisladores en los Congresos. Este trabajo exploratorio inicia con el análisis de los mecanismos de la democracia, identificando el papel de la iniciativa ciudadana y/o popular. En un segundo momento, se revisa la legislación subnacional y nacional de México. Y finalmente, se presentan algunos casos de activación.AbstractThe mechanism of legislative initiative activated by citizens has been taken into consideration in the sub-national legislation since 1996, and in the Political Constitution of the United States of Mexico since 2014. The tension between direct participation and representative models of decision-making in the concept of the modern state is a subject under constant debate (Resnick 2007: 77–80). What rules are established in the Mexican law concerning the mechanisms of citizens’ initiative? How do they function in the Mexican democracy? This exploratory work starts with the analysis of mechanisms of democracy, identifying the role of citizens’ legislative initiative. In the second part, the sub-national and national legislation of Mexico is reviewed. Finally, some cases of citizens’ legislative initiatives are presented.
