This opinion deals with a government bill on the funding of the cross‑border healthcare which implements the Directive 2011/24/EU of the European Parliament and of the Council. Both the content of the directive and the bill are presented in the opinion. The author points out a number of defects of the bill, including the inconsistent application of the exemptions provided for in the directive, unjustified differentiation of patient’s right to reimburse costs of healthcare depending on whether the it is carried out by healthcare providers established on the territory of the Republic of Poland or elsewhere, and imprecisely defined mechanism for determining the amount of the reimbursement, as well as application of many vague phrases and, above all, the introduction of the rigid instrument of the so‑called “suspension” of the patient’s right to reimbursement in the event of excess of the statutory limit of spending in a given year.

The opinion discusses the compatibility of the government bill with the Directive 2011/24/EU of the European Parliament and of the Council, pointing out in particular the need to remove from the project and clarify the vague concepts of questionable issues. The author shows that the bill imposes numerous restrictions on patients, related both to the need to obtain prior authorization of healthcare and spending limits for a given year, as well as the constraints of a formal nature that may hinder the patients from using cross‑border healthcare serivces. In conclusion, it she notes that the objective to reduce the proportion of patients who wait for treatment would not be achieved.

The article concerns the financial aspects of the Polish health care system. It presents the sources of its financing as well as its legal aspects, it also mentions health care patterns from other countries. The authors focus on the biggest areas of financial mismanagement in the health care, such as inadequate allocation of funds and faulty functioning of the health insurance system. The article refers also to the current health crisis connected with the COVID-19 pandemic.

W artykule omówiono finansowe aspekty funkcjonowania polskiego systemu ochrony zdrowia. Przedstawiono źródła jego finansowania i prawne aspekty działania oraz przytacza wzorce stosowane w innych krajach. Skupiono się na obszarach marnotrawienia środków finansowych w systemie zdrowotnym, omówiono przede wszystkim nieodpowiednie rozdysponowanie funduszy oraz wadliwe rozwiązania w zakresie ubezpieczeń zdrowotnych. Analiza zawiera również odniesienia do obecnej sytuacji zdrowotnej związanej z pandemią COVID-19.
