Artykuł koncentruje się na problemie ratyfikacji przez Polskę Konwencji Rady Europy w sprawie zapobiegania i zwalczania przemocy wobec kobiet i przemocy domowej. Obejmuje on analizę zgodności z Konstytucją RP niektórych przepisów Konwencji. Zdaniem autora, konwencja nie zawiera postanowień ogólnych sprzecznych z Konstytucją RP. Autor stoi na stanowisku, że właściwa interpretacja tego dokumentu wymaga analizy jego autentycznych tekstów w języku angielskim i francuskim, a nie dostępnych polskich, mylących tłumaczeń. Dodatkowo istotny jest Raport wyjaśniający, który jako dokument sporządzony w związku z przygotowaniem Konwencji jest istotną wskazówką interpretacyjną.

The article focuses on issues related to ratification in Poland of the Council of Europe Convention on preventing and combating violence against women and domestic violence. It includes an analysis of constitutionality of the certain provisions of the Convention. In the author’s view, the Convention does not contain any provisions inconsistent with the Constitution of Poland. However, he claims that proper interpretation of this document requires analysis of its authentic texts in English and French.

The article presents the results of the research concerning legal support of the constitutional rights of children in Ukraine. The author focuses on the theoretical and practical aspects of the rights implementation into the domestic law as well as the implementation of the international instruments regulating public relations in the sphere of the rights and children’s freedom protection within the country law.

One of the agreements belonging to the United Nations Treaty on human rights is the Convention on the Rights of the Child, adopted on November 20, 1989. It is a fundamental document of the international protection of the rights of the child. On this basis, an organ was created to ensure the observance of the right in the Convention – the Committee on the Rights of the Child. In the later years three Optional Protocols were adopted. The first two concern substantive law – the Optional Protocol to the Convention on the Rights of the Child on the Involvement of Children in Armed Conflict and the Optional Protocol to the Convention on the Rights of the Child on the sale of child prostitution and child pornography of 25 May 2010. The Third Optional Protocol to the Convention on the Rights of the Child on a communications procedure of 19 December 2011 introduces the reform of the Committee on the Rights of the Child through the procedure of individual and interstate notifications. This article focuses on the analysis of the changes and attempts to assess their practical application.

Jedną z umów należących do traktatowego systemu ochrony praw człowieka Narodów Zjednoczonych jest Konwencja o prawach dziecka przyjęta w dniu 20 listopada 1989 r. Stanowi ona główny dokument międzynarodowej ochrony praw dziecka. Na jej podstawie powstał organ mający na celu zapewnienie przestrzegania praw zawartych w Konwencji – Komitet Praw Dziecka. W późniejszych latach do Konwencji przyjęto trzy protokoły fakultatywne. Dwa pierwsze dotyczą prawa materialnego – Protokół fakultatywny do Konwencji o prawach dziecka w sprawie angażowania dzieci w konflikt zbrojny oraz Protokół fakultatywny do Konwencji o prawach dziecka w sprawie handlu dziećmi, dziecięcej prostytucji i dziecięcej pornografii (oba z dnia 25 maja 2010 r.). Trzeci Protokół fakultatywny do Konwencji o prawach dziecka w sprawie procedury składania zawiadomień z dnia 19 grudnia 2011 r. wprowadza reformę Komitetu Praw Dziecka przez procedurę indywidualnych i międzypaństwowych zawiadomień. Treść niniejszego opracowania dotyczy analizy wprowadzonych zmian i stanowi próbę oceny ich praktycznego zastosowania.

The UN Special Rapporteurs are independent experts holding mandates of special procedures established by the Human Rights Council. One of their main methods of work is conducting country visits, at the invitation of States. The article aims at assessing country visits as the way of monitoring the human rights situation at the national level. It provides an overview of the last visits in Poland, including the visit of the Special Rapporteur on independence of judges and lawyers in October 2017, focusing on the recommendations issued by Special Rapporteurs in their reports presented to the Human Rights Council and the reaction of Polish Government to the Rapporteur's findings. The Special Rapporteurs' independence and expertise turns country visits reports into a valuable source of information on the situation of human rights that can be used, inter alia, by National Human Rights Institutions and non-governmental organizations. However, the impact of the visit depend mostly on the State's will to implement the Special Rapporteurs' recommendations.
