The article is devoted to changes, which – in the sphere of spatial planning referring to the mining area – have been introduced by the Act of 9 June 2011 the Geological and Mining Law. Author presented the evolution of regulations concerning the mining area, emphasizing its protective nature, and concerning the above mentioned plans, first introduced by the Act of 4 February 1994 the Geological and Mining Law. In the latter aspect he noticed that the plan, which was then obligatory, alluded to the plans of functional area, which were regulate by the Act of 12 July 1984 of spatial planning. The plan guaranteed the integration of actions taken within the mining area. Analyzing the current legal rules author paid attention that they do not provide for the obligation of elaborating the plan. He criticized this solution and recognized it as a regress in comparison with previous one, disabling the realization of the integration function. In his opinion the new prescriptions are redundant, because the spatial plans are optional also in the light of general provisions. Besides this, the new regulation raises many further doubts, in particular it may limit so called spatial planning autonomy of municipalities, depending the possibility to draw up a plan of additional conditions.

The vision of the prospective transformation of the mining area in the foothills of the Ore Mountains (Podkrušnohoří), as expressed by the physical planning documentation of the Region of Ústí nad Labem, should be enhanced by a more detailed framework determining a stable and sustainable trajectory of the region’s future development. When taking into account local specifics in the planning of the area’s transformation, the local population is a relevant actor and participant. A sociological research has analyzed the attitudes of the population of Podkrušnohoří to current socioeconomic developments in the region and mining and post-mining activities. The results of the research were replenished and supported by the opinions of representatives of municipal administrations. The research has helped us to understand how this structurally affected region is perceived by its inhabitants, what factors have an influence on their attitudes and reactions, and which impacts these factors can have on the stability and social cohesion of the population.

Do vize budoucí transformace těžební oblasti Podkrušnohoří, která je vyjádřena v krajské územně plánovací dokumentaci Zásad územního rozvoje Ústeckého kraje (ZÚR ÚK), by měl být promítnut detailnější koncepční rámec, jenž by stanovil stabilní a udržitelnou trajektorii dalšího rozvoje tohoto regionu. K zohlednění místních specifik v procesu plánování budoucí transformace těžební oblasti Podkrušnohoří je neopomenutelným aktérem a účastníkem místní obyvatelstvo. Provedený sociologický výzkum analyzoval postoje obyvatelstva Podkrušnohoří k současnému socioekonomickému vývoji regionu a probíhajícím těžebním i post-těžebním aktivitám. Výsledky průzkumu byly dále doplněny a podpořeny názory zástupců samosprávy obcí a měst. Výzkum přispívá k hlubšímu pochopení, jakým způsobem je vnímán tento strukturálně postižený region jeho obyvateli, jaké jsou významné faktory, které mají vliv na jejich postoje a reakce, a jaké mohou mít tyto faktory dopady na stabilitu a soudržnost obyvatel Podkrušnohoří.

This article discusses legal regulations regarding the decision on environmental conditions, with special emphasis on projects in the field of geology and mining. It covers the matter of investment decisions which are essential for geology and mining. There have been discussed the issues of projects requiring the decision on environmental conditions and the procedure for obtaining such a decision. The basic terms such as geology and mining, the decision on environmental conditions, the concession, selected investment decisions, geological works, the mining area as well as the mine operating plan have also been explained in this article. Moreover, there has been discussed the matter of public authorities competent to issue decisions on environmental conditions. This article includes examples of practical problems derived from jurisdiction. It also indicates changes in the regulations regarding the decision on environmental conditions, taking into account activities in the field of geology and mining.

Данная статья анализирует правовые регуляции касающиеся решения об экологических условиях для намечаемых инвестиции. Особое внимание уделяется инвестициям в области геологической и горной деятельности. Обсуждается существенные для геологии и горного дела инвестиционные решения. В статье комментируется как инвестиции, требующие получения решения об экологических условиях, так и порядок его предоставления и компетентные в этой сфере органы публичной администрации. Объяснено базовые понятия, такие как: геология и горное дело, решение об экологических условиях, концессия, избранное инвестиционные решения, геологические работы, горной отвод, план развития горных работ. Автор указывает также на примеры проблем возникающих в судебной практике и рассматривает изменения произошедшие в правовой регуляции решения об экологических условиях с учётом вопросов, относящихся к геологической и горной деятельности.
