The article is an essay to answer the question whether, in the light of the current International Criminal Court’s in Hague rights, it is possible to hold Russian Federation accountable for international crimes. The answer to this question depends on the type of crimes committed, as some of them (such as the crime of aggression) should be considered as excluded from the jurisdiction of the ICC. The article also points to other possible ways of holding Russia accountable, such as the establishment of a special ad hoc tribunal, which is widely discussed, among others, in the European Parliament. The outcome of these discussions is a resolution of January 19, 2023.

Prezentowany artykuł stanowi opracowanie mające odpowiedzieć na pytanie, czy w świetle przysługujących MTK kompetencji możliwe jest pociągnięcie do odpowiedzialności Federacji Rosyjskiej za zbrodnie popełnione w związku z konfliktem w Ukrainie. Odpowiedź na to pytanie nie jest jednoznaczna, zależy ona bowiem od rodzaju popełnionych przestępstw, niektóre bowiem z nich (jak np. zbrodnię agresji) należy uznać w tym wypadku za wyłączone spod jurysdykcji MTK. Artykuł wskazuje również na inne możliwe sposoby pociągnięcia Rosji do odpowiedzialności, takie jak powołanie specjalnego trybunału ad hoc, o którym szeroko dyskutuje się w ramach UE, m.in. w Parlamencie Europejskim. Rezultatem tych dyskusji jest rezolucja Parlamentu Europejskiego z dnia 19 stycznia 2023 r.
