Artykuł zawiera analizę podstawowych założeń bezpośredniej likwidacji szkód z ubezpieczenia odpowiedzialności cywilnej posiadaczy pojazdów mechanicznych w dwóch wariantach. Wariant pierwszy, jednostronny polega na przyjmowaniu przez ubezpieczyciela OC zlecenia likwidacji szkody od własnego klienta. Wariant drugi, wielostronny polega na wzajemnym zlecaniu likwidacji szkód przez ubezpieczycieli objętych ogólnorynkowym porozumieniem i – co dyskusyjne – zleceniu poszkodowanego. W artykule podjęte zostały kwestie wpływu wprowadzenia bezpośredniej likwidacji szkód na wzmożenie konkurencji jakościowej pomiędzy ubezpieczycielami (polegającej na poprawie jakości likwidacji szkód). Słowa kluczowe: bezpośrednia likwidacja szkód, ogólnorynkowe porozumienie, likwidacja jednostronna, likwidacja wielostronna.

The article contains an analysis of the basic assumptions of direct claim settlement in motor third party liability insurance in two options: a unilateral settlement by a liability insurer of a claim of their own clients and a multilateral variant consisting in mutual ordering of loss adjustment by insurers covered by a general market agreement and - what is questionable - of a victim. Furthermore, the article discusses the influence of direct claim settlement upon the reinforcement of the quality competition among insurers (to improve the quality of claim settlement).
