Konsekwencje zmiany terminu głosowania w wyborach samorządowych w 2018 roku

The subject of the article is the analysis of the consequences of changing the date of voting in local elections, introduced by the Act of January, 11, 2018, amending certain acts to increase the participation of citizens in the process of electing, functioning and controlling certain public bodies. The introductory part of the study discusses the premises that were the direct cause of the change of Art. 371 paragraph 1 of the Polish Electoral Code in 2018. In the next part the author examines the evolution of the construction of the date of voting in local elections in subsequent election acts, starting from 1990. The third and fourth parts of the article discusses in detail the effects of the change in the date of voting introduced in 2018. The author pays attention to the lack of a systematic approach of the legislator to amending Art. 371 paragraph 1 of the Polish Electoral Code.

Przedmiotem niniejszego artykułu jest analiza konsekwencji zmiany terminu głosowania w wyborach samorządowych, dokonanej ustawą z dnia 11 stycznia 2018 roku o zmianie niektórych ustaw w celu zwiększenia udziału obywateli w procesie wybierania, funkcjonowania i kontrolowania niektórych organów publicznych. W części wstępnej opracowania omówiono przesłanki, które stanowiły bezpośrednią przyczynę zmiany brzmienia art. 371 § 1 Kodeksu wyborczego w 2018 roku. W dalszej kolejności przedstawiono ewolucję konstrukcji terminu głosowania w wyborach samorządowych w kolejnych ustawach wyborczych, począwszy od 1990 roku. W części trzeciej i czwartej artykułu zostały omówione skutki, jakie wywołała zmiana terminu głosowania wprowadzona w 2018 roku. Szczególną uwagę zwrócono na brak systemowego podejścia ustawodawcy do nowelizacji art. 371 § 1 Kodeksu wyborczego.
