The article presents the bio-waste separate collection problems. The aim of the study was examination of the usefulness of the biodegradable bags.and Its tests were carried out both in Germany and in Poland by Municipal Waste Management Plant from Gac, Lower Silesia. The residents of Gać region examined the bags and later fill in a questionnaire, as it was done in Germany recently. Based on results it can be found that the biodegradable bags influence on residents life and waste management company, as well. The cost reduction of waste management system, improving the residents quality of life and the positive assessment of local authorities involved in this project can be noticed.

The aim of the article is to define the boundaries of the legal notion of ‘munic­ipal solid waste’ with respect to solid waste produced in uninhabited property, i.e. outside households. Setting of those boundaries has a significant meaning for tasks and competences of municipalities in the area of solid waste management. It determines, inter alia, the material scope of local legal acts concerning collec­tion of solid waste from property owners, and in consequence, also the extent of tenders organised in this field by the municipal authorities. The authors advocate a broad understanding of the analysed notion, justified by the wording of the relevant legal provisions and the effectiveness of the solid waste management for which municipalities are responsible. The subjectmatter of the article is analysed in the light of both the Polish and EU legal regulations and jurisprudence.

Celem artykułu jest określenie granic pojęcia prawnego „odpady komunalne” w odniesieniu do odpadów powstających na nieruchomościach niezamieszkałych, tj. poza gospodarstwami domowymi. Wyznaczenie tych granic ma istotne znaczenie dla zadań i kompetencji gmin w zakresie gospodarki odpadami. Determinuje m.in. zakres przedmiotowy aktów prawa miejscowego w sprawie odbieraniu odpadów komunalnych od właścicieli nieruchomości, a w konsekwencji także zakres organizowanych w tej sferze przez organy gminy przetargów. Autorzy opowiadają się za szerokim ujęciem analizowanego pojęcia, uzasadnionym zarówno brzmieniem odnośnych przepisów, jak i wymogami efektywnej gospodarki odpadami, za którą odpowiedzialność ponosi gmina. Zagadnienie stanowiące przedmiot artykułu jest analizowane z uwzględnieniem zarówno polskich, jak i unijnych regulacji prawnych oraz orzecznictwa.

Nowadays, achieving of sustainable development became impossible without effective, both from an environmental and from an economic view, solution of the problem of recycling of solid waste. The paper gives an overview of the ecological and economic efficiency of the main existing methods for utilization of solid domestic waste, namely, incineration in combustion plants, biothermal composting, pyrolysis, plasma gasification, use of combined methods. The essence of the widespread methods of utilization of solid domestic waste, their scope. The main drawbacks of the existing methods of solid domestic waste utilization were also outlined: such incineration in combustion plants is the most appropriate from the economic point of view, but poorly solves the problem of environmental pollution, because a significant part of harmful substances do not burn at temperatures used in incineration plants and the process is accompanied by a significant amount of emissions of harmful substances and carbon dioxide into the atmosphere; when using a biothermal composting, debris, with all heavy metal impurities, radioactive and other possible harmful substances, is just applied to the fields as a fertilizer or in a greenhouse as a biofuel; when pyrolysis is used, the unit's capacity for the process to dispose of household waste cannot be large; to carry out the process of pyrolysis of such low-calorific fuel as solid household waste, considerable additional energy resources are required, which causes high operating costs; the process of plasma combustion to neutralize domestic waste is quite energy intensive, which is why it is not currently self-supporting at the moment.
