A wide margin of discretion by a given contracting authority to shape competition rules in procedures not covered by The Provisions of The Public Procurement Law shall give the possibility to strengthen its actions aimed at ensuring competitiveness and transparency. This is reflected in the internal rules set up by the contracting authorities, the design of which shall provide a theoretical framework aimed at ensuring the competitiveness in question. The author, based on the Ordinance of the Mayor of the City introducing the Order Regulations, excluding the Act, has attempted to identify areas that build competitive in procurement. Moreover, he proposed and described the copyright dimensions of the competitiveness, as well as, pointed out measures and indicators enabling the measurement of competitiveness of public procurement.

Duża dowolność w kształtowaniu reguł konkurencyjności w procedurach nieobjętych przepisami ustawy Pzp przez danego zamawiającego daje możliwość umacniania jego działań skierowanych na zapewnienie konkurencyjności i przejrzystości. Wyrazem tego są tworzone przez zamawiających regulaminy wewnętrzne, których konstrukcja powinna dawać teoretyczne ramy ukierunkowane na zapewnienie rzeczonej konkurencyjności. Autor w oparciu o Zarządzenie Prezydenta Miasta wprowadzające Regulamin zamówień poza ustawą dokonał próby zidentyfikowania obszarów budujących konkurencyjność zamówień. Ponadto zaproponował i opisał autorskie wymiary rozpatrywania konkurencyjności oraz wskazał mierniki i wskaźniki umożliwiające pomiar konkurencyjności zamówień publicznych.

It is possible to state that the organisation and way of functioning of the state administration has gone and will be going through an incessant development process, which has responded and will be responding to the changes and needs of the society. The analysis, which can be considered as an audit made for certain clients groups, is, besides others, also a starting point for the elaboration of an overall municipality strategy. The analysis can be realised by means of primary or secondary research. The present state of our society and the developmental tendencies taken in consideration, it is clear that the existence of leisure activities system will be a significant element in the decision-making processes of state employees on all levels of state (public) administration. The relationship between those who can influence the outer forces and those who occupy positions in the leisure-time organizations defines the dynamics of the future development. The role of municipalities in the domain of public services cannot be replaced. That is why it is necessary to study the opinions and attitudes of employees responsible on the local scale. It is also important for the information transfer and communication to be realized rapidly.

Organizacja i sposób funkcjonowania administracji państwowej jest procesem zależnym od potrzeb i zmian społeczeństwa. Aktywność fizyczna podejmowana przez pracowników z tego sektora będzie wpływać na proces podejmowanych przez nich decyzji zawodowych.

Artykuł opisuje stosunki narodowościowo-religijne w Kodniu w latach 1918-1944. Do chwili wybuchu drugiej wojny światowej żyli obok siebie w tej nadbużańskiej osadzie obywatele pol-scy: narodowości polskiej, rusińskiej/ukraińskiej oraz żydowskiej; będący w różnych propor-cjach katolikami i neounitami, prawosławnymi oraz wyznawcami religii mojżeszowej. W okre-sie II RP najliczniejszą grupą wyznaniową w Kodniu byli wierni Kościoła katolickiego obrządku łacińskiego (rzymskokatolickiego); stanowili ponad 45% mieszkańców wsi. Zarówno wyznaw-cy Kościoła prawosławnego, jak i religii mojżeszowej stanowili w przybliżeniu po 20% ogółu mieszkańców. Najmniej liczną grupą wyznaniową (do 5%) byli neounici, wyznawcy Kościoła katolickiego obrządku bizantyjsko-słowiańskiego. Przez cały omawiany okres ponad 10% mieszkańców Kodnia było ateistami. Historia Kodnia wiąże się z wizerunkiem Matki Boskiej Kodeńskiej i jej opiekunami zakonnikami ze zgromadzenia Misjonarzy Oblatów Maryi Niepoka-lanej (OMI). Po drugiej wojnie światowej w Kodniu zmieniła się struktura narodowościowo-wyznaniowa. Z różnych, niezależnych od siebie przyczyn, przestały istnieć bezpowrotnie dwie spośród czterech grup wyznaniowych, tj. wierni Kościoła katolickiego obrządku bizantyjsko-słowiańskiego oraz wyznawcy religii mojżeszowej. W nowych realiach geopolitycznych (okres PRL) żyli obok siebie w Kodniu bez zatargów na tle religijnym wyznawcy Kościoła rzym-skokatolickiego i wierni Cerkwi prawosławnej.

This article describes national and religious relations in Kodeń in the years 1918-1944. Until the outbreak of World War II, Polish, Ruthenian/Ukrainian and Jewish citizens lived together in this Bug River settlement. During the Second Polish Republic, the most numerous denomi-national group in Kodeń were the faithfuls to the Latin Rite Catholic Church (Roman Catholic); accounted for over 45% of the rural population. Both the followers of the Orthodox Church and the Mosaic religion constituted approximately 20% of the total population. The least nu-merous religious group (up to 5%) were Neounits, followers of the Catholic Byzantine-Slavic rite. Over the entire period, over 10% of Kodnia's residents were atheists. The whole history of Kodeń is associated with the holy image of Our Lady of Kodeń and her religious guardians from the Congregation of the Missionary Oblates of Mary Immaculate (OMI). After the Second World War, the ethnic and religious structure in Kodeń has changed . For various reasons beyond their control, two of the four religious groups: Neounits and Jews ceased to exist irretrievably. In the new geopolitical realities (from the period of the Polish People's Republic till nowadays) Roman Catholics and the Orthodoxs have been living in Kodeń without any religious disagreements.

Podjętym w niniejszym artykule zamierzeniem badawczym jest udzielenie odpowiedzi na dwa pytania. Pierwsze brzmi: czy status prawnopodatkowy gminy w zakresie podatku od towarów i usług (VAT) w danej transakcji można zawsze wyznaczyć precyzyjnie? Drugie: czy zawarcie umowy cywilnoprawnej przez polską gminę jest warunkiem sine qua non uzyskania przez nią statusu podatnika VAT? Przedstawione w opracowaniu tezy i argumentacja jednoznacznie wskazują, że w obowiązującym w Unii Europejskiej, w tym w Polsce, systemie VAT precyzyjne określenie statusu gminy jako podatnika w danej transakcji aktualnie nie zawsze jest możliwe, a zawarcie przez gminę umowy cywilnoprawnej nie zawsze jest wystarczające do uzyskania przez nią w danej transakcji statusu podatnika. Wykorzystany materiał badawczy obejmuje krajowe i zagraniczne prawo materialne, doktrynę oraz praktykę, w ramach której szczególną rolę odgrywa aktualne orzecznictwo organów podatkowych, sądów administracyjnych i TSUE.

The research goal undertaken in this article is to answer two questions. First, can a municipality’s legal tax status in the field of tax on goods and services (VAT) in each transaction always be determined precisely? Second, is the conclusion of a civil law contract by a Polish municipality a sine qua non condition for it to obtain VAT taxable status? Theses presented in the publication, and arguments clearly indicate that with the VAT system in force in the European Union, including Poland, it is not always possible to precisely define the status of a municipality as a taxpayer in a given transaction; and the conclusion of a civil law contract by a municipality is not always sufficient for it to obtain the status of a taxpayer in a given transaction. The research material used includes domestic and foreign substantive law, doctrine and practice, in which current case law of tax authorities, administrative courts and the CJEU plays a special role.
