W postępowaniu restrukturyzacyjnym nadzór nad majątkiem dłużnika sprawuje nadzorca sądowy, który wykonuje obowiązki o istotnej doniosłości nie tylko dla postępowania układowego. Efekty jego działań mają wpływ na tryb i terminy zaspokojenia wierzycieli dłużnika, ale w określonych sytuacjach mogą w ogóle wpływać na możliwość choćby częściowego ich zaspokojenia. Wobec tego ważną kwestią jest określenie uprawnień i obowiązków nadzorcy sądowego, a tym samym jego charakteru i pozycji prawnej w postępowaniu układowym, a także zakresu jego odpowiedzialności za szkody, jakie może wyrządzić przy pełnieniu swojej funkcji. Przedmiotem niniejszego artykułu jest przedstawienie kluczowych kwestii wiążących się ze stanowiskiem prawnym nadzorcy sądowego oraz próba określenia roli, jaką przyznał mu ustawodawca w postępowaniu układowym.

In restructuring proceedings, supervision over the debtor’s assets is exercised by a judicial supervisor, who performs duties of significant importance not only for the arrangement proceedings. The effects of the judicial supervisor’s actions have an impact not only on the manner and timing of satisfying the debtor’s creditors, but in certain situations may influence the possibility of even partial satisfaction of the creditors. Therefore, an important issue is to determine the powers and duties of the judicial supervisor and thus his character and legal position in the arrangement procedure. The subject of this article is the presentation of the above issues and an attempt to determine the role that has been assigned to it by the legislator in the arrangement procedure.

In the scientific paper a significance of the entry of perpetual-accounting warning about the running restructuring proceedings was analysed for starting civil judicial proceedings. This entry enables the orchard in civil cases in particular from the scope of the right in rem, of concerning real estates arriving at information about opening and conducting restructuring proceedings. Acquainting a civil court with the plot of the land register shown information is being obtainedand is linking legal effects with them for the judicial civil procedure. In particular through their prism the court is assessing the procedural card of individual entities to starting the judicial civil procedure and undertaking procedural activities in his course. In the scientific paper an establishment constituted the aim of presented deliberations, as this entry is used this way for keeping above regularities activities and in the process of completion of the protection of the legal interest of participants in restructuring proceedings. The object perpetual-accounting entry prevents the nullity of judicial proceedings.

W artykule naukowym analizie poddano znaczenie wpisu wieczystoksięgowego ostrzeżenia o prowadzeniu postępowania restrukturyzacyjnego dla wszczęcia postępowania sądowego cywilnego. Wpis ten umożliwia sadowi w sprawach cywilnych w szczególności z zakresu prawa rzeczowego, dotyczących nieruchomości powzięcie informacji o otwarciu i prowadzeniu postępowania restrukturyzacyjnego. Sąd cywilny zapoznając się z treścią księgi wieczystej uzyskuje wskazane informacje i łączy z nimi skutki prawne dla sądowego postępowania cywilnego. W szczególności poprzez ich pryzmat sąd ocenia legitymację procesową poszczególnych podmiotów do wszczęcia sądowego postępowania cywilnego i podejmowania w jego toku czynności procesowych. Wpis ten służy w taki sposób zachowaniu prawidłowości powyższych czynności i tym samym realizacji ochrony interesu prawnego uczestników postępowania restrukturyzacyjnego. Przedmiotowy wpis wieczystoksięgowy zapobiega nieważności postępowania sądowego.
