The right to life is one of the most important human rights, if not the most important one. This is mainly due to the fact that without it, it is impossible to exercise other rights. Despite that, or precisely because of that, the right to life is a widely discussed topic, especially when concerning its beginning and end. Determining the moment when human life begins is fundamental for setting legal regulations concerning, for example, the handling of stem cells, artificial termination of pregnancy or childbirth. This article deals not only with determining the beginning of human life, but also with the abovementioned related areas of law, which it evaluates from the perspective of compliance with Czech constitutional law.

Právo na život je jedno z nejdůležitějších lidských práv, ne-li to nejdůležitější právo, což plyne zejména ze skutečnosti, že bez něj nelze využívat práva ostatní. I přesto nebo právě proto je právo na život věčně aktuálním a diskutovaným tématem, zejména v souvislosti s otázkami týkajícími se jeho počátku a konce. Určení okamžiku, kdy začíná lidský život, má přitom zásadní význam pro nastavení právní úpravy týkající se například nakládání s kmenovými buňkami, umělého přerušení těhotenství nebo porodů. Tento článek se zabývá nejen určením počátku lidského života, ale i zmíněnými navazujícími oblastmi práva, které hodnotí z pohledu souladnosti s ústavním právem České republiky.
