The article deals with the representation of World War II in the German Generation War and focuses on one particular plot, connected with the character of a German Jew who joins a Home Army unit. The way these events had been depicted, led to a lawsuit filed by a Home Army veteran and the Home Army World Alliance against the producers of the series. The main subject of the analysis are two main, extensive court letters (the lawsuit and the answer to it). They refer to both general issues (concerning the classification of historical films) and specific ones, namely five particular scenes from the film. On this basis, the author builds an argument, in the first part broadening the spectrum of theoretical reflection, and in the latter part concentrating on the interpretation of controversial scenes from the series. The analysis leads to the conclusion that the stylistic pattern applied by the creators and the multitude of textual elements used in the series is particularly important for the consideration of the objections raised by the complainant and during the trial.

Artykuł dotyczy sposobu reprezentacji II wojny światowej w niemieckim miniserialu Nasze matki, nasi ojcowie. Autor skupia się na jednym wątku, związanym z postacią niemieckiego Żyda, który trafia do oddziału Armii Krajowej. Kanwą rozważań jest pozew sądowy wystosowany przez kombatanta AK oraz Światowy Związek Armii Krajowej przeciw producentom serialu. Zasadniczym przedmiotem analizy są dwa główne, obszerne pisma sądowe (pozew oraz odpowiedź nań). Odnoszą się one zarówno do zagadnień ogólnych – dotyczących klasyfikacji filmów historycznych, jak i szczegółowych – pięciu konkretnych scen z filmu. Na tej podstawie autor buduje wywód w pierwszej części poszerzający spektrum refleksji teoretycznej, w drugiej zaś – koncentrujący się na interpretacji kontrowersyjnych scen z serialu. Analiza prowadzi do wniosku, że mnogość zastosowanych w serialu elementów jest szczególnie istotna dla rozpatrzenia zastrzeżeń wnoszonych przez stronę skarżącą.

The subject of the considerations taken up by the authors in this article is the legal issues related to the possibility of pursuing a claim for infringement of personal rights on the Internet from the direct infringer through the prism of necessity to establish the personal data of the infringer unknown. The possibility of submitting an application for making this data available to the service provider was discussed, taking into account both the position expressed by the Court of Justice of the European Union and the national administrative courts. Attention was drawn to the fact that the difficulty in establishing these data (in accordance with the provisions of the Act of 18 July 2002 on the provision of electronic services) results in an incorrect practice of initiating criminal proceedings, which in turn causes the investigative authorities to be burdened with tasks that do not serve the purposes of the criminal trial but in fact civil cases.

Przedmiotem rozważań podjętych przez Autorów w niniejszym artykule jest problematyka prawna związana z możliwością dochodzenia roszczenia z tytułu naruszenia dóbr osobistych w Internecie od bezpośredniego sprawcy naruszenia przez pryzmat konieczności ustalenia danych osobowych naruszyciela. Omówiono możliwość złożenia wniosku o udostępnienie tych danych do service providera, uwzględniając zarówno stanowisko wyrażane przez ETS, jak i krajowe sądownictwo administracyjne. Zwrócono uwagę na fakt, że trudność w ustaleniu tych danych (przede wszystkim zgodnie z zapisami ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną) skutkuje nieprawidłową praktyką inicjowania postępowania karnego, co z kolei powoduje obciążenie organów dochodzeniowych zadaniami nie służącymi celom procesu karnego a cywilnego.

The aim of the analysis carried out in this article was to indicate the scope of liability for violation of personal interests of a human being by a person who places a hyperlink on the Internet which include a material violating personal interests of another person. In addition, the analysis was made in which situations, referring to the action under the counter-law, this person will evade responsibility. During the analysis, the authors focused their attention on the issue of violation of personal interests in the form of honor, although making the disclosure, a specific user may also infringe other personal rights, including those mentioned in art. 23 Civil Code. In the considerations, it has been taken into account that the violation of honor can take the form of verbal as well as non-verbal communication, but it can also occur through the inclusion of a specific content using the functionality of social networking sites. A distinction has also been made between the materials being made, bearing in mind the subject from which the particular material originates, as well as the entity that makes it available. This issue is not without significance for the eventual possibility of evading the liability by a person who shares hyperlink.

Celem analizy przeprowadzonej w niniejszym artykule było wskazanie zakresu odpowiedzialności za naruszenie dóbr osobistych osoby, która w Internecie umieszcza hiperlink do materiału naruszającego dobra osobiste innej osoby. Ponadto analizie poddano, w jakich sytuacjach, powołując się na działanie w ramach kontratypu, osoba ta będzie mogła uchylić się od odpowiedzialności. W toku analizy autorzy skupili uwagę na problematyce naruszenia dobra osobistego w postaci czci, choć dokonując udostępnienia, określony użytkownik może naruszyć także inne dobra osobiste, w tym wymienione w art. 23 k.c. W rozważaniach uwzględniono, iż naruszenie czci może przybrać zarówno postać przekazu werbalnego, jak i niewerbalnego, ale także może nastąpić przez zamieszczenie określonej treści z wykorzystaniem funkcjonalności serwisów społecznościowych. Dokonano także rozróżnienia udostępnianych materiałów, mając na uwadze podmiot, od którego określony materiał pochodzi, jak i podmiot, który go udostępnia. Kwestia ta nie pozostaje bowiem bez znaczenia dla ewentualnej możliwości uchylenia się od odpowiedzialności przez podmiot udostępniający materiał.
