Artykuł podejmuje tematykę trybu dochodzenia przez funkcjonariuszy służb mundurowych roszczeń majątkowych i niemajątkowych powstałych ze stosunków służbowych. Przedstawia zmiany, jakie zaistniały w tej materii w poglądach orzecznictwa i regulacjach ustawowych. Wychodząc z założenia, że stosunek służbowy łączy w sobie elementy administracyjnoprawne oraz elementy zobowiązaniowe i jest szeroko rozumianym zatrudnieniem, autorka zauważa pozytywną tendencję do usuwania stanu niepewności co do dopuszczalności drogi dochodzenia roszczeń funkcjonariuszy przed sądem powszechnym, wskazuje także na niewystarczalność ochrony prawnej przed zachowaniami przełożonych naruszającymi godność funkcjonariuszy, zachowaniami dyskryminacyjnymi i mobbingującymi w porównaniu z sytuacją pracowników, wyznaczoną przepisami kodeksu pracy.

The article concerns the ways of persuing pecuniary and non – pecuniary claims from service-based relations, by functionaries of non-military uniformed services. It also presents the amendments in judicial decisions and in legal regulations concerning this area. Assuming that a service-based relation contains the essentials of both administrative and labour law, and that it is one of the legal basis of employment, the author notices a positive tendency to eliminate the state of uncertainty concerning the permissibility of rights vindication in the court of law; the author points to the insufficiency in the legal protection against the superiors’ actions infringing the functionaries’ dignity, discriminating and mobbing the subordinates as compared with the situation of the employees regulated by the labour law regulations.
