Zasada demokratycznego państwa prawnego w polskiej praktyce prawnej

Cel: ustalenie zakresu stosowania normy ustrojowej państwa prawnego w praktyce. Metoda prawno-porównawcza. Wniosek: norma ustrojowa nie jest jasno określona oraz adekwatnie stosowana. Konieczność zmiany tego stanu rzeczy w doktrynie i praktyce prawnej, a także poprawy świadomości prawnej społeczeństwa. Treść: jeśli ustrojem Polski jest demokratyczne państwo prawne to elementarną kwestią jest rozumienie tego pojęcia, w tym jego wykładnia przez Trybunał Konstytucyjny oraz reguły stosowania jego treści normatywnej. Trybunał dokonał tu bardzo szerokiej wykładni łącząc tę kategorię z ponad 20 zasadami konstytucyjnymi. Taka obszerność pojęcia zaciemnia jego istotne elementy i niekorzystnie wpływa na stosowanie kategorii normatywnej przez organy państwa. Artykuł ma charakter koncepcyjny.

Aim: to ascertain the scope of application of the constitutional norm of the state of law in practice. The legal comparative method. Conclusion: the constitutional norm is not clearly determined of adequately applied. The necessity to change this state of affairs in the legal doctrine and practice as well as to improve the society’s legal awareness. Contents: if the system of Poland is a democratic state of law, then the elementary issue is understanding of this notion, including interpretation thereof by the Constitutional Tribunal as well as the rules of application of its normative contents. The Tribunal made here a very broad interpretation combining this category with more than 20 constitutional rules. Such an ampleness of the notion obscures its essential elements and unfavourably affects the use of the normative category by the state’s bodies. The article is of the conceptual nature.
