The paper describes some worrying tendencies in polish criminal proceedings towards weaken the protection of professional secrecy of notaries. The author explains that incorrect application of rules of conflict of laws, and the resulting subordination of notarial secrecy to provisions of the Code of Criminal Procedure, threatens not only the good of the state and important private interests, but also notary’s impartiality, and even may lead to question qualifications of notaries.
