Tekst jest analizą regulacji kontroli osobistej dokonywanej przez Policję z punktu wi-dzenia konstytucyjnych warunków ograniczenia korzystania z praw i wolności. Wyrok Trybunału Konstytucyjnego doprowadził do zmian w ustawie o Policji. Rozszerzyły one jednak zakres stosowania tej czynności. Artykuł wskazuje elementy tej regulacji, które przesądzają o jej niezgodności z konstytucyjnymi warunkami ograniczenia korzystania z praw i wolności jednostki.

The text is an analysis of the regulation concerning the personal search carried out by the Police from the perspective of constitutional limitation upon the exercise of freedoms and rights. The judgment of the Constitutional Tribunal led to changes in the Police Act. However, they extended the scope of this power. The article indicates the elements of this regulation which determine its non-compliance with the constitutional conditions for limitation upon the exercise of individual rights and freedoms.
