The article undertakes an analysis of the grounds, purpose and scope of copyright limitation in relation to works permanently displayed on publicly accessible roads, streets, squares or gardens in so-called freedom of panorama. With regard to copyright restrictions, which constitute an exception to their absolute protection provided for in the Act, it is reasonable to specify and justify the purpose of permitted public use. The article indicates and justifies the basis for the restriction as: access to culture, stating that this concept is not the same as the definition of a cultural good. To this end, a concise interpretation of the restrictive provision was made, as well as an analysis of legal guarantees in the field of access to culture, cultural heritage, cultural heritage in legal regulations, with particular emphasis on the definition of the good of culture, indicating the lack of coherence of the concepts of the work and the good of culture.

W artykule podjęto analizę podstaw, celu i zakresu ograniczenia praw autorskich w odniesieniu do utworów wystawionych na stałe na ogólnie dostępnych drogach, ulicach, placach lub w ogrodach w zakresie tzw. prawa panoramy. W odniesieniu do ograniczeń praw autorskich, stanowiących wyjątek od bezwzględnej ich ochrony przewidzianej w ustawie o prawie autorskim i prawach pokrewnych (Dz.U. nr 24, poz. 83 ze zm.), zasadne jest określenie i uzasadnienie celu dozwolonego użytku publicznego. W artykule wskazano i uzasadniono podstawę ograniczenia jako dostęp do kultury, zastrzegając że pojęcie to nie jest tożsame z definicją dobra kultury. W tym celu dokonano zwięzłej wykładni przepisu ograniczającego, a także analizy gwarancji prawnych w zakresie dostępu do kultury, dziedzictwa kultury, spuścizny kulturowej w regulacjach prawnych, ze szczególnym uwzględnieniem definicji dobra kultury, wskazując brak koherentności pojęć utworu i dobra kultury.

The information purpose, as a premise for the fair use of works in the press, should be understood taking into account the functions of the press in the information society. The article interprets the meaning of an entity authorized to benefit from the restriction of copyright, taking into account the scope of the right to information. The constitutive function of the press is its informativeness, and the other functions, such as entertainment, control or education, are its consecutive features, but the informativeness of the message occurs within all the functions carried out by the press.

Cel informacyjny, jako przesłanka dozwolonego użytku utworów w prasie powinien być rozumiany z uwzględnieniem funkcji, jakie pełni prasa w społeczeństwie informacyjnym. Artykuł dokonuje wykładni znaczeniowej podmiotu uprawnionego do skorzystania z ograniczenia, z uwzględnieniem zakresu pojęcia informacyjności. Konstytutywną funkcją prasy jest jej informacyjność, a pozostałe funkcje, takie jak np. rozrywkowa, kontrolna czy edukacyjna stanowią jej cechy konsekutywne, jednak informacyjność przekazu występuje w obrębie wszelkich funkcji realizowanych przez prasę.
