The author considers the theory of operational and investigative activities in terms of philosophical, legal, organizationaland tactical aspects. The development of the theory of operational and investigative activities as an independent system ofknowledge is happening constantly and presents a reflection of certain social practices in the fight against crime. The experienceof operational and combat activities to fight crime in Russia has been constantly accumulated and generalized, being realizedin methodological recommendations, regulatory acts and other documents. The author observes that the theory of operationaland investigative activities, and other branches of science, develops under the general laws of science and the laws in force withrespect to its individual sectors. The article defines the normative regulation of tactics, which means that the legislator or agencyrecognized the most effective, rational and expedient way to proceed. The author emphasizes that for both operational combattactics, prevention of crimes and the study of best practices, the most important task is to develop and experimentally verify suchrules, which then receive regulatory consolidation. Tactical recommendations that have been proven by the best practices, receivedscientific evidence and, especially, past experimental verification, acquire mandatory application in practice even without receivinga normative form. This reflects the traditional anticipatory value of the theory over the rulemaking process. The article shows thatonly such techniques and methods that have proven to be unconditionally required in typical situations in all cases of the operationaland investigative activities should become the subject of legal regulations.

W artykule omówione zostały uprawnienia operacyjno-rozpoznawcze służb specjalnych w kontekści ich ingerencji w konstytucyjne prawa i wolności obywatelskie. Autor podejmuje próbę definicyjnej systematyzacji pojęcia "czynności operacyjno-rozpoznawcze" oraz ich podziału. Poszczególne środki i metody dyskrecjonalnej pracy służb specjalnych podlegają różnym reżimomprawnym dotyczącym ich stosowania. Różnią się stopniem ingerencji w swobody obywateli, jak również zakresem ochrony praw i wolności obywatelskich przed ich nieuzasadnionym stosowaniem. Część z nich objęta jest kontrolą sądów i prokuratury, natomiast część pozostaje jedynie w kompetencji kierownictwa służb. W istotny sposób problem ten dotyczy nieobjętych żadną kontrolą zewnętrzną retencji i pobierania danych telekomunikacyjnych. Precyzyjny system rozwiązań prawnych, regulujących stosowanie niejawnego instrumentarium służb, ma szczególne znaczenie dla zachowania równowagi pomiędzy koniecznością zapewnienia bezpieczeństwa a prawem obywateli do prywatności i swobody komunikowania się.

The article discusses secret services’ operational and investigative powers from the perspective of their interference in the constitutional rights and civil liberties. The author makes an attempt at defining the operational and investigative activities and drafting a classification thereof. Particular measures and methods of secret services’ confidential activities are governed by various legal regimes. They differ in terms of the degree of interference in civil liberties as well as the scope of protection of civil rights and liberties against unjustified use. Some operational methods remain under the supervision of courts and public prosecutor’s office, while others are used only at the discretion of secret services’ management. It is a burning issue in the context of retaining and obtaining telecommunications data without any external supervision. A comprehensive system of legal solutions that regulates the set of secret methods used in secret services is fundamental for maintaining a balance between the need to safeguard security and the citizens’ rights to privacy and the freedom of communication.
