30 grudnia 2016 r. weszły w życie zmiany do ustawy z 28 marca 2003 r. o transporcie kolejowym. Nowe regulacje wprowadzają obowiązek udostępniania od 10 grudnia 2017 r. przewoźnikom kolejowym obiektów infrastruktury usługowej. Zgodnie z nowelizacją ustawy o transporcie kolejowym obiekt infrastruktury usługowej to obiekt budowlany wraz z gruntem, na którym jest usytuowany, oraz instalacjami i urządzeniami, przeznaczony w całości lub w części do świadczenia jednej lub większej liczby usług, o których mowa w ust. 2 i 3 załącznika nr 2 do ustawy o zmianie ustawy o transporcie kolejowym. Zgodnie z założeniami ustawy nowelizującej ustawę na rynku kolejowym pojawił się nowy podmiot, tj. operator obiektów infrastruktury usługowej. Mianem operatora obiektu infrastruktury usługowej określono podmiot wykonujący działalność polegającą na zarządzaniu obiektem infrastruktury usługowej lub świadczeniu na rzecz przewoźników kolejowych co najmniej jednej z usług, określonych w ust. 2 i 3 załącznika nr 2 do projektowanej ustawy. Zgodnie z nowym stanem prawnym Prezes UTK sprawuje nadzór nad sprawiedliwym i niedyskryminującym traktowaniem wszystkich przewoźników kolejowych w zakresie dostępu do obiektów infrastruktury usługowej.

Recent amendments to the Act of 28 March 2003 on Railway Transport came into force on 30 December 2016. The new law introduces the obligation to provide access for railway undertakings to railway service facilities starting from 10 December 2017. According to the amendments in the Act on Railway Transport, the term ‘railway service facility’ means the building and the ground area on which it is situated, the installations and equipment, wholly or in part, dedicated to the provision of one or more of the services referred to in paragraphs 2 and 3 of the Annex 2 to the Act on Railway Transport. In accordance with the provisions of the Act amending the Act on Railway Transport, a new entity – the operator of service facilities – has appeared. The concept of an ‘operator of service facility’ means an entity managing the service facility or supplying one or more services to railway undertakings referred to in paragraphs 2 and 3 of the Annex 2 to the Act on Railway Transport. According to the new regulations, the President of the Office of Railway Transport (UTK) supervises fair and non-discriminatory treatment of all railway undertakings in terms of access to service facilities.
