The paper focuses on the preferential taxation of natural persons’ incomes stemming from intellectual property rights in the context of articles 30ca-30cb of the Polish personal income tax act (IP Box). The content and context of the aforementioned regulations were analyzed, as well as selected interpretive and practical problems identified in rulings of administrative courts. The subject matter was juxtaposed against related regulations of French law. The level of relevant tax rates in effect in other foreign jurisdictions was also taken into consideration

Praca poświęcona jest preferencyjnemu opodatkowaniu dochodów osób fizycznych z praw własności intelektualnej w kontekście treści przepisów art. 30ca-30cb ustawy o podatku dochodowym od osób fizycznych (IP Box). W opracowaniu poddano w szczególności analizie treść i kontekst wyżej wymienionych regulacji oraz wybrane problemy interpretacyjne a także praktyczne zidentyfikowane w orzecznictwie sądów administracyjnych. Badane kwestie zostały zestawione z odpowiednimi regulacjami prawa francuskiego. Uwzględniono także poziom odpowiednich stawek podatkowych obowiązujących w innych wybranych prawodawstwach obcych.
