Artykuł poświęcony jest wybranym zagadnieniom i propozycjom zmian przedstawionym w projekcie założeń ustawy o zmianie ustawy o ochronie konkurencji i konsumentów (uokik). Projekt został opublikowany przez Prezesa UOKiK i przekazany do konsultacji społecznych w maju 2012 r. W pierwszej kolejności autorka zwraca uwagę na znaczenie ustawy o swobodzie działalności gospodarczej dla projektowania zmian przepisów uokik o kontroli w toku postępowania przed Prezesem UOKiK. Po drugie, artykuł porusza niektóre kwestie dotyczące środków zaradczych oraz tzw. dobrowolnego poddania się karze. W ostatnim części autorka skupia uwagę na pewnych problemach związanych z karami pieniężnymi oraz odpowiedzialnością osób fizycznych.

The article is concerned with the discussion of some of the issues and suggestions outlined in the draft assumptions for an act amending the Act on competition and consumer protection (ACCP). The draft document was published by the President of the Office of Competition and Consumer Protection (OCCP) for consultation in May 2012. First, the author explains the significance of the Act on freedom of economic activity for drafting amendments to the provisions in ACCP relating to inspections in proceedings before the President of the OCCP. Second, emphasis is laid on some issues related to remedies and so-called no-contest plea. Last, the author concentrates on some problems related to fines and liability of individuals.
