In the interpretation of criminal law, an important role is played by the presumption of the common (general, colloquial) meaning of statutory expressions. Determining the common meaning in the process of applying the law is usually based on the linguistic intuition of the procedural authority or on dictionaries. In the article, we present an alternative sourceof knowledge about the common meaning of linguistic corpora. The use of corpora as a tool of legal interpretation has been intensively discussed in American literature for several years. The main objections are raised in the context of criminal law. The article reviews the main arguments raised in the American debate and relates them to Polish legal culture. Moreover, some exemplary corpus analyzes in criminal cases are presented, both in the context of legal interpretation and the assessment of linguistic elements of the facts of the case.

W interpretacji prawa karnego dużą rolę odgrywa domniemanie znaczenia powszechnego (ogólnego, potocznego) wyrażeń ustawowych. Ustalanie znaczenia powszechnego w procesie stosowania prawa odbywa się zwykle na podstawie intuicji językowej organu procesowego lub słowników. W artykule przedstawiono konkurencyjne źródło wiedzy o znaczeniu powszechnym, jakim są korpusy językowe. Wykorzystanie korpusów jako narzędzia wykładni prawa jest od kilku lat intensywnie dyskutowane w literaturze amerykańskiej. Główne zastrzeżenia zgłaszane są w kontekście prawa karnego. Artykuł zawiera przegląd głównych argumentów podnoszonych w amerykańskiej debacie i odniesienie ich do polskiej kultury prawnej. Ponadto, przedstawione zostały przykładowe analizy korpusowe na gruncie spraw karnych, zarówno w kontekście wykładni prawa, jak i oceny językowych elementów stanu faktycznego.

This paper introduces language corpora as linguistic tools and considers their potential use for law. The author focuses in particular on their role in the interpretation of law and analyses the current state of knowledge in this area. The first part of the paper presents the essence of linguistic corpora, discusses their functions and potential uses. The second part deals with the reconstruction of the ordinary meaning doctrine and explores how this doctrine can be linked to the use of language corpora. The third part considers the transferability of the conclusions of this doctrine and the use of language corpora to the Czech legal setting. It examines how these techniques relate to the linguistic method of interpreting law and demonstrates their importance, especially in order to exclude linguistic intuition and respect linguistic reality, by the example of the work of the case law of the highest courts with linguistic interpretation (textualism). This analysis is intended to contribute to a better understanding of the use of linguistic corpora and the application of the doctrine of ordinary meaning in the interpretation of law (especially in the use of linguistic interpretation).

Tento článek představuje jazykové korpusy jako lingvistické nástroje a zvažuje jejich možné využití pro právo. Autor se zaměřuje zejména na jejich roli při interpretaci práva a provádí analýzu dosavadního stavu poznání v této oblasti. V první části článku je představena podstata jazykových korpusů, jsou rozebrány jejich funkce a potenciální využití. Druhá část se zabývá rekonstrukcí doktríny „ordinary meaning“ a zkoumá, jak může být tato doktrína propojena s použitím jazykových korpusů. Ve třetí části je zvažována přenositelnost závěrů této doktríny a použití jazykových korpusů do českého prostředí. Je zkoumáno, jak tyto techniky souvisí s jazykovou metodou interpretace práva, a na příkladu práce judikatury vrcholných soudů s jazykovým výkladem je demonstrována jejich důležitost, obzvlášť za účelem vyloučení jazykové intuice a respektování jazykové reality. Tato analýza má přispět k lepšímu porozumění využití jazykových korpusů a aplikace doktríny obecného významu při interpretaci práva (zejména při využívání jazykového výkladu).
