One of the forms of public tasks is to create organizational entities by units local government. Social help is a special task of the community and this is why the law maker has introduced an obligation for municipalities the local government units which are the closest to residents, to create an organizational unit in the form of municipal social welfare centre. This unit performs a significant part of tasks, including those aimed at citizens at risk of exclusion. Thus it is a good legal instrument, helping to partially solve the problem of how to get to the persons concerned.

From 1 January 1999, in force in Poland a three–tier structure of local government : municipal government , county government , the provincial government . Tasks that perform individual units of local government are divided into their own tasks and commissioned . Local government is a separate territorial units in the structure of the state, created by law relationship of the local population. Association any, appointed to exercise public administration is equipped with the material means for the implementation of the tasks imposed on them. Article will present safety level administrative unit, which is the municipality. Analysis of literature as well as explore the statutory provisions relating to the widely known security will be a key objective set out the issues . Public safety as an important element of the local community . The tasks of the municipality as well as the possibility of taking appropriate decisions during the occurrence of hazards . Preparation of municipalities to take action and secure material and financial . Municipality in order to perform the task can create organizational units or enter into agreements with other entities that will be shown and described in the article. Pojęcie jednostek nieposiadających osobowości prawnej jest niewątpliwie pojęciem prawnym w prawie administracyjnym, które pojawia się równocześnie na gruncie prawa materialnego oraz proceduralnego. Określenie istoty jednostek organizacyjnych nieposiadających osobowości prawnej wymaga zwrócenia uwagi na kryterium zdolności prawnej. Chodzi w zasadzie o zdolność administracyjnoprawną, czyli zdolność prawną wyznaczoną przez normę prawa administracyjnego. Z pewnością jednostkom organizacyjnym nieposiadającym osobowości prawnej w prawie administracyjnym można przypisać jedynie częściową zdolność prawną.

The concept of entities without legal personality is undoubtedly a legal concept in administrative law, which appears simultaneously in substantive and procedural law. Determining the essence of organizational units without legal personality requires attention to the criterion of legal capacity. It is basically about administrative and legal capacity, i.e. legal capacity determined by the norm of administrative law. Certainly, organizational units without legal personality under administrative law can be assigned only partial legal capacity.

Der Begriff der Einheiten ohne eigene Rechtspersönlichkeit ist zweifellos ein juristischer Begriff im Verwaltungsrecht, der gleichzeitig auf der Grundlage des materiellen Rechts und des Verfahrensrechts auftaucht. Um das Wesen der Organisationseinheiten ohne eigene Rechtspersönlichkeit zu bestimmen, muss man die Aufmerksamkeit auf das Kriterium der Rechtsfähigkeit richten. Es geht tatsächlich um die verwaltungsrechtliche Fähigkeit, also durch die Norm des Verwaltungsrechts bestimmte Fähigkeit. Schließlich kann man die Organisationseinheiten ohne eigene Rechtspersönlichkeit auf der Grundlage des Verwaltungsrechts als Organisationseinheiten mit Teilrechtsfähigkeit betrachten.
