This article deals with the consequences of exercising the right to request the submission of payment guarantee (Article 6493 k.c. of the Civil Code). The author presents the risks and drawbacks arising from the fact that this mechanism is being used contrary to its purpose. In addition, the article contains suggestions for changes that will ensure that the interests of both sides of the investment process are protected.

Artykuł poświęcony jest konsekwencjom wykorzystywania przez wykonawców regulacji wynikającej z art. 6493 k.c. w sposób niezgodny z jej celem. Autor prezentuje mankamenty legislacyjne powyższej regulacji oraz przedstawia propozycje zmian, które zapewnią poszanowanie interesów zarówno wykonawcy, jak i inwestora w związku ze zgłoszonym przez wykonawcę żądaniem ustanowienia gwarancji zapłaty.
