This article describes the history of the penalisation of persuasion or assistance in suicide in various legal systems including the Polish penal codes. This crime was listed in the 1932 Criminal Code, the 1969 Criminal Code, and the 1997 Criminal Code. Currently the maximum penalty for this oﬀence in terms of duration is the same as in the 1932 and 1969 Criminal Codes. Penalties should always be applied as a last resort, but in the case of a legally protected good as important as human life, it seems the criminal liability of oﬀenders should be a punishment they will recognise as adequately severe with respect to the oﬀence.

Niniejszy artykuł opisuje historię penalizacji przestępstwa namowy lub udzielenia pomocy w samobójstwie w ramach m.in. polskich kodeksów karnych. Wyżej wymienione przestępstwo zostało ujęte w kodeksie karnym z 1932 r., kodeksie karnym z 1969 r. oraz w kodeksie karnym z 1997 r. Aktualna maksymalna sankcja z tytułu tego występku – w zakresie czasu jej trwania - jest tożsama z tą występującą w kodeksie karnym z 1932 r. oraz w kodeksie karnym z 1969 r. Sankcje karne zawsze powinny być stosowane w ostateczności, niemniej w przypadku tak ważkiego dobra chronionego prawem jak ludzkie życie wydaje się, iż istnieć winna możliwość pociągnięcia do odpowiedzialności karnej danego sprawcy w zakresie kary będącej dla niego realną dolegliwością.
