Przedmiotem prowadzonych rozważań są przepisy ustawy o prawie autorskim i prawach pokrewnych dotyczące instytucji dozwolonego użytku w zakresie, w jakim służy ona swobodnemu – i zgodnemu z prawem – przepływowi informacji. W początkowej części artykułu dokonano charakterystyki utworu oraz praw autorskich, tak osobistych, jak i majątkowych. Następnie autorka wyjaśnia konstrukcję dozwolonego użytku z przywołaniem stosownych przepisów ustawy. Dalsza część rozważań dotyczy korzystania z utworu dla celów informacyjnych – prawa przedruku oraz korzystania z utworu podczas relacjonowania bieżących zdarzeń oraz zasad rozpowszechniania informacji o dziełach wystawionych.

The article shortly presents the issueof permissible use of protected works, which comes from the Act on Copyright and Related Rights. In author,s opinion it is useful solution, as informative purposes are required. At the beginning the author describes work and author’s moral and economics rights, then permissible use of protected works and its legal regulations. The next part of article said about permissible use of works which is justified by the purpose of the information. Some rules of broadcasting some materials through the press, radio and television and also quoting in the reports of current events and disseminating the works exhibited in commonly accessible public collections in press and television current event reports are described.

Preaching sermons and homilies is a key form of teaching the faithful and spreading religious worship, subject to the regulations of canon and secular law. The article focuses on Polish copyright law and regulations resulting therefrom enabling lawful creation of preaching, as well as the use of works, including preaching previously disseminated by other pastors. In this respect, the fair use institution should be included, including fair use, quotation, fair use in speeches, external presentations and lectures, and fair use during ceremonies and events.

Głoszenie kazań i homilii jest kluczową formą nauczania wiernych i szerzenia kultu religijnego, podlegającą regulacjom prawa kanonicznego i świeckiego. 178 Artykuł koncentruje się na polskim prawie autorskim i wynikających z niego regulacjach umożliwiających zgodne z prawem tworzenie kazań, jak też korzystanie z utworów, w tym kazań wcześniej rozpowszechnionych przez innych duszpasterzy. W tym zakresie szczególne znaczenie posiada instytucja dozwolonego użytku obejmująca m.in. dozwolony użytek osobisty, prawo cytatu, dozwolony użytek w ramach przemówień, publicznych wystąpień i wykładów oraz dozwolony użytek podczas ceremonii i uroczystości.
