Prawo dostępu do broni palnej obywateli polskich w świetle unormowań prawnych i bezpieczeństwa

W artykule przedstawiono problematykę związaną z prawem do posiadania broni palnej przez obywateli Rzeczypospolitej w kontekście bezpieczeństwa oraz obecnych rozwiązań legislacyjnych. Wskazano jak prawo do posiadania broni palnej funkcjonuje, jakie ma podłoże historyczne oraz jakie ma znaczenie dla bezpieczeństwa w Stanach Zjednoczonych, Szwajcarii oraz Czechach. Zwrócono uwagę na restrykcyjną politykę polskiego ustawodawcy względem rzeczonego prawa. W końcowej części artykułu postawiono pytanie czy trudności w pozyskaniu broni przez obywateli polskich można byłoby tłumaczyć ewentualną obawą ustawodawcy o wzrost przestępczości z użyciem broni palnej, a tym samym troską o bezpieczeństwo obywateli. W odpowiedzi starano się syntetycznie i logicznie wytłumaczyć konieczność zmiany obecnego stanu prawnego. Dla zobrazowania problemu przedstawiono mapę stawiającą Polskę na końcu listy państw europejskich pod względem ilości sztuk broni przypadających procentowo na 100 obywateli.

The article presents the problem related to the right to firearms by citizens of the Republic of Poland in the context of safety and current legislative solutions. It shows how the right to own firearms functions, what is the historical background and what is important for security in the United States, Switzerland and the Czech Republic. Attention was drawn to the restrictive policy of the Polish legislator regarding this law. The final part of the article posed a question whether the difficulties in obtaining weapons by Polish citizens could be explained by the possible fear of the legislator about the increase in crime with the use of firearms, and thus concern for the safety of citizens. The answer was to synthetically and logically explain the necessity to change the current legal status. To show the problem, a map was presented where Poland was at the end of the list of European countries in terms of the number of weapons per 100 citizens.
