Personal liability insurance is still not popular as a way to cover accidental injury or damage to the property of a third party. The aim of the conducted research was to identify the limit of coverage and popularity of personal liability insurance on the Polish insurance market. This article presents the number of insurers offering personal liability insurance, the number of policies and the gross written premiums from 2004 until 2009. In depth analysis of the personal liability insurance, general conditions was conducted and the popularity of personal liability insurance among the employees of the Marshal's Office in Olsztyn was surveyed.

In her article, the author presents issues related to personal liability for breaching public finance discipline, after amendments introduced to the Act, in force since 11th February 2012. The article comprises important information on those regulations that have been changed or are controversial in application, related to persons who may be subject to this kind of liability. The conclusions might be of significance to the improvement of public finance protection.

The article discusses the framework of liability for anti-competitive conduct of a genuinely independent third party as set forth in relevant judgments. It refers to concepts of third party liability in the light of the principle of personal responsibility developed by doctrine and jurisprudence. The CJEU has set out important rules relating to liability of an undertaking for actions of its independent service provider. However, it still left some important issues unresolved. The paper focuses on the test for the attribution of anti-competitive conduct of a service provider and refers to its interpretation and application. It questions whether the introduced test provides sufficient legal certainty for undertakings. It briefs on the steps that must be taken by undertakings to distance themselves from an infringement and offers some suggestions how to limit or prevent exposure to liability

L’article traite du cadre de la responsabilité d’un tiers véritablement indépendante pour un comportement anticoncurrentiel, tel qu’énoncé dans les jugements pertinents. Il fait référence aux concepts de responsabilité d’un tiers à la lumière du principe de la responsabilité personnelle développé par la doctrine et la jurisprudence. La CJUE a énoncé des règles importantes relatives à la responsabilité d’une entreprise pour les actions de son prestataire de services indépendant. Cependant, certaines questions importantes n’ont toujours pas été résolues. L’article se focalise sur le test d’attribution du comportement anticoncurrentiel d’un prestataire de services et se réfère à son interprétation et à son application. Il s’interroge sur le point de savoir si le test introduit offre une sécurité juridique suffisante aux entreprises. Il fait un résumé des mesures à prendre par les entreprises pour se distancer par rapport à une infraction et propose des suggestions sur la manière de limiter ou d’empêcher toute exposition à la responsabilité.

Cet article se concentre sur la responsabilité personnelle des dirigeants d’entreprise pour les infractions au droit de la concurrence. Cet article commence par l’examen du régime de sanction des dirigeants d’entreprises selon la loi sur la concurrence de la République de Lituanie. Nous examinons les dispositions légales et la pratique judiciaire des tribunaux lituaniens à partir de 2017, date à laquelle la première demande de sanction à l’encontre d’un dirigeant d’entreprise a été déposée. Il est souligné que dans la plupart des cas, les tribunaux ne satisfont pas entièrement les demandes du Conseil de la concurrence en ce qui concerne la sévérité des sanctions imposées aux dirigeants. Dans la deuxième partie de l’article, nous analysons en détail la jurisprudence des tribunaux administratifs de la République de Lituanie et révélons les éléments clés pour l’imposition de sanctions aux dirigeants. Premièrement, dans des circonstances exceptionnelles, les tribunaux peuvent imposer une sanction inférieure à celle prévue par la loi. Deuxièmement, les tribunaux peuvent imposer à la fois des sanctions principales et des sanctions supplémentaires ou n’importe laquelle d’entre elles. Troisièmement, le niveau des sanctions doit être déterminé à la lumière des amendes imposées aux entreprises pour des infractions au droit de la concurrence. L’article se termine par un bref résumé.

This article focuses on the personal liability of managers of undertakings for breaches of competition law. This article starts with a review of the sanction regime for managers of undertakings according to the Competition law of the Republic of Lithuania. Reviewed are legal provisions and judicial practice of the Lithuanian courts starting from 2017, that is, when the first request to sanction a manager of an undertaking was submitted to the court by the Competition Council (CC). It is pointed out that in most cases the courts do not fully accept the requests of the CC with respect to the severity of the sanctions to be imposed on managers. The second part of the Article comprehensively analyses the case-law of administrative courts of the Republic of Lithuania, and presents key elements of the imposition of sanctions on company managers. Firstly, in exceptional circumstances, courts may impose a lower penalty than the one specified by competition law. Secondly, the courts may impose both, the main sanction as well as an additional one, or any of them. Thirdly, the level of sanctions should be determined the light of the fines imposed on undertakings for their infringements of competition law. The article concludes with a short summary.
