The aim of the article is to discuss new legal regulations of the MDR and to draw attention to some issues raising doubts regarding the social acceptance of the provisions of the Act (reporting tax schemes as aggressive tax optimization vs general obligation to report tax events) or violating the principle of non-retroactivity, as well as violation provisions regarding the competence of the executive.

Artykuł jest próbą przedstawienia wątpliwości jakie rodzą nowe przepisy nakładające obowiązek raportowania schematów podatkowych (naruszenie tajemnicy zawodowej, naruszenie zasady niedziałania prawa wstecz, ingerencja władzy wykonawczej w kompetencje władzy ustawodawczej) oraz odbiór społeczny wprowadzonych przepisów. W artykule został doceniony sam kierunek w zakresie walki z agresywną optymalizacją podatkową. Celem pośrednim było zobrazowanie skutków jakie rodzi zbyt pośpieszna legislacja, zwłaszcza w zakresie problematycznej materii koncepcyjnej – brak precyzji czy też konieczność publikowania objaśnień podatkowych
