Polish Marian devotion is reflected in the Polish law. Literal references to Saint Mary are contained in legal acts of public authorities, as well as acts enacted by local government bodies. These acts occupy different places in the system of sources of law. Most of them does not raise a constitutional objection, the legality of others is a debatable issue (eg. City council resolution expressing the will of Mary’s patronage on the city), and a few are contrary to the principle of religious, ideological and philosophical impartiality of the public authorities. Symbolic dimension of legal references to Mary – eg. Mary’s images in the municipal coats of arms or Mary’s name used in public streets names – demonstrates responsiveness of the Polish legal order to religious beliefs of some citizens, while not denying the paradigm of the separation of church and state, and without prejudice to the rights and freedoms of other people.

Pobożność maryjna Polaków znajduje swoje odzwierciedlenie w polskim prawie. Literalne odwołania do Matki Bożej zawierają akty prawne naczelnych organów władzy publicznej, jak i akty stanowione przez organy samorządu terytorialnego. Akty te przejawiają duże zróżnicowanie co do kategoryzacji i miejsca w systemie źródeł prawa. Większość z nich nie budzi zastrzeżeń natury konstytucyjnej, legalność innych jest kwestią nieoczywistą (np. uchwała rady miasta wyrażająca wolę ustanowienia Maryi patronką miasta), nieliczne zaś stoją w sprzeczności z zasadą religijnej, światopoglądowej i filozoficznej bezstronności władz publicznych. Symboliczny wymiar odwołań w prawie do Maryi – np. obecność wizerunku Maryi w herbach gmin czy nazwanie imieniem Maryi publicznej ulicy – dowodzi responsywności polskiego porządku prawnego wobec przekonań religijnych części swych obywateli, zarazem nie przecząc paradygmatowi rozdziału Kościoła od państwa i nie naruszając praw i wolności innych osób.

Celem niniejszego artykułu jest zbadanie skutków wejścia w życie ustawy z dnia 4 listopada 2022 r. o zmianie ustawy o prawach konsumenta, ustawy Kodeks cywilny oraz ustawy Prawo prywatne międzynarodowe, stanowiącej wyraz implementacji tzw. dyrektywy towarowej. Autor analizuje to zagadnienie z wykorzystaniem metody formalno-dogmatycznej, koncentrując się na wpływie zmian wprowadzonych przez wymienioną powyżej ustawę na standard ochrony konsumenta oraz sposób prowadzenia działalności gospodarczej przez przedsiębiorców. Ponadto identyfikuje najistotniejsze problemy związane z implementacją dyrektywy towarowej do polskiego porządku prawnego, zwracając uwagę na konsekwencje prawne i ekonomiczne wyborów i rozwiązań przyjętych przez polskiego ustawodawcę. Dokonuje też oceny zarówno treści przedmiotowej ustawy, jak i treści dyrektywy towarowej, formułując wnioski de lege ferenda.

The purpose of the article is to examine the effects of the entry into force of the Act of 4 November 2022 amending the Consumer Rights Act, the Civil Code Act and the Private International Law Act, being a result of the implementation of the so-called Sale of Goods Directive. The author analyses the issue using the formal-dogmatic method, focusing on the impact of the changes introduced by the above-mentioned Act on the standard of consumer protection and the manner in which entrepreneurs conduct their business activities. Moreover, he identifies the most significant problems related to the implementation of the Sale of Goods Directive into the Polish legal order, drawing attention to the legal and economic consequences of the choices and solutions adopted by the Polish legislator. He also assesses both the content of the Act in question and the content of the Sale of Goods Directive, formulating de lege ferenda conclusions.
