Article is a review about the concerns of the concept of “child welfare” as a negative condition for granting a divorce in the light of diagnosis conducted at the request of courts in the Opinio-dawczych Zespołach Specjalistów Sądowych. It presents the legal and psychological approaches to the child’s welfare in the context of the crisis in the family as divorce. Comments are also presented on the scope of research conducted by OZSS specialists on the impact of divorce on the child’s welfare and selected problems related to their specificity. Based on the selected literature on the subject, jurisprudence and the work practice of specialists in the field of psychology, subjec-tive views on the methodology of examining the impact of divorce on the well-being of children were also presented. The main thesis of the text is the view that the family courts commissioning the examination of the negative premise for divorce by OZSS specialists is controversial.

Tekst ma charakter przeglądowy i dotyczy problematyki pojęcia „dobra dziecka” jako negatywnej przesłanki udzielenia rozwodu w perspektywie badań prowadzonych na zlecenia sądów w Opiniodawczych Zespołach Specjalistów Sądowych. Przedstawiono w nim prawne i psychologiczne ujęcia dobra dziecka w kontekście kryzysu w rodzinie, jakim jest rozwód. Prezentowane są również uwagi dotyczące zakresu badań prowadzonych przez specjalistów OZSS w przedmiocie wpływu rozwodu na dobro dziecka oraz wybrane problemy, jakie wiążąsię z ich specyfiką. Na podstawie wybranej literatury przedmiotu, orzecznictwa i praktyki pracy specjalistów z zakresu psychologii w OZSS, przedstawiono także subiektywne poglądy dotyczące metodologii badania wpływu rozwodu na dobro dzieci. Główną tezą tekstu jest pogląd o kontrowersyjności zlecania przez sądy rodzinne badania negatywnej przesłanki orzeczenia rozwodu przez specjalistów OZSS.
